COUNTY OF SALT LAKE ) I, Vicki Johnson, being first duly sworn upon my oath depose and state as follows: 1. That I am a Beneficiary named in The Margie Deen Johnson Living Trust dated July 15, 1965. I make this Affidavit pursuant W.S. §34-2-123 for purpose of defining the representative capacity of the Grantees named in the conveyances described herein, and setting forth the information required by W.S. §34-2-122. 2. That on May 10, 1973 in Book 104PR on Page 488 as entry number 446980 of the records of the Lincoln County Clerk was recorded a Warranty Deed from Margie D. Johnson to Margie D. Johnson and Zions First National Bank, in trust, as co-tenants, describing the following described land: See attached Exhibit A for Legal Description. 3. That on April 29, 1977 in Book 135PR on Page 578 as entry number 492371of records of Lincoln County Clerk was recorded a Quitclaim Deed from Margie D. Johnson and Zions First National Bank as Trustees to Margie D. Johnson and Preston Wursten in Trustees as Joint Tenants conveying the following described land: See attached Exhibit A for Legal Description. 4. The Warranty Deed and the Quitclaim Deed conveying the property to the Trust failed to properly define the Trust as required by W.S., §34-2-122 in that the date of the Trust was not shown and the name of the Trust was not listed. On both conveyances the date of the Trust is July 15, 1965 and the name of the Trust is The Margie Deen Johnson Living Trust. Affiant makes the statements contained herein in the capacity as beneficiary of The Margie D. Johnson Living Trust. :-00872 Dated this 1st day of June, 2005.
