JOHNSON AND LORI A. JOHNSON, Hereinafter referred to as "Borrower"; WITNESSETH: WHEREAS, Borrower has executed that certain Deed of Trust dated MARCH 15, 2005, and recorded in the records of the County of LINCOLN, State of WYOMING, encumbering the following described property: BEGINNING AT THE SOUTHWEST CORNER OF THE SOUTHEAST QUARTER SOUTHEAST QUARTER OF SECTION 7, TOWNSHIP 34 NORTH, RANGE 118 WEST OF THE 6TM P.M., LINCOLN COUNTY, WYOMING, AND RUNNING EAST 165 FEET: THENCE NORTH 528 FEET: THENCE WEST 165 FEET: THENCE SOUTH 528 FEET TO THE POINT OF BEGINNING. WHEREAS, the said Deed of Trust recited as incorrect: THE DEED OF TRUST EXECUTED AND RECORDED WITHOUT THE SIGNATURE OF RICHARD L. JOHNSON ON THE BALLOON RIDER SECOND MORTGAGE. ALSO, THE BALLOON NOTE ADDENDUM SECOND MORTGAGE DOCUMENT WAS RECORDED WITH THE DEET OF TRUST. NOW THEREFORE, Borrower hereby agrees that said Deed of Trust is amended to reflect the following: THE DEED OF TRUST EXECUTED AND RECORDED WITH THE SIGNATURE OF RICHARD L. JOHNSON ON THE BALLOON RIDER SECOND MORTGAGE. THE BALLOON NOTE ADDENDUM SECOND MORTGAGE DOCUMENT IS REMOVED FROM RECORDING WITH THE COUNTY OF LINCOLN. FURTHER, it is agreed between the parties that this agreement is hereby incorporated into the said Deed of Trust. and hereby made a part thereof; and further that all other terms, conditions, provisions and obligations of said Deed of Trust are hereby ratified and confirmed. (the "Lender") of the same date and covering the property described in the Security Instrument and located at 777 LOST CREEK ROAD, THAYNE, WYOMING 83127 (the "Property"). Additional Covenants. Notwithstanding anything to the contrary set forth in the Note or Security Instrument, Borrower and Lender further covenant and agree as follows: THIS LOAN IS PAYABLE IN FULL AT MATURITY. YOU MUST REPAY THE ENTIRE PRINCIPAL BALANCE OF THE LOAN AND UNPAID INTEREST THEN DUE. LENDER IS UNDER NO OBLIGATION TO REFINANCE THE LOAN AT THAT TIME. YOU WILL, THEREFORE, BE REQUIRED TO MAKE PAYMENT OUT OF OTHER ASSETS THAT YOU MAY OWN, OR YOU WILL HAVE TO FIND A LENDER, WHICH MAY BE THE LENDER YOU HAVE THIS LOAN WITH, WILLING TO LEND YOU THE MONEY. IF YOU REFINANCE THIS LOAN AT MATURITY, YOU MAY HAVE TO PAY SOME OR ALL OF THE CLOSING COSTS NORMALLY ASSOCIATED WITH A NEW LOAN EVEN IF YOU OBTAIN REFINANCING FROM THE SAME LENDER.
