HomeMy WebLinkAbout90924808/09/2005 ::i:. :;:FAX 307 885 5787 LOWER ::~:q:q':"+ ENERGY WORK ORDER # 61033 SEC.20, T37N, R118W DISTRIBUTION EASEMENT KNOW ALL MEN BY THESE PRESENT: That the undersigned, Reinhart Edwards LLC, Ganelle Edwards, Managing Member, ("Grantor") for a good and valuable consideration, the receipt of which is hereby acknowledged, do hereby grant, convey a nd warrant unto Lower Valley Energy, a Cooperative Corporation, of A/ton and Jackson, Wyoming and to its successors and assigns, ("Grantees"), a perpetual easement and right of way for the construction and continued maintenance, repair, alteration and replacement of the electric distribution circuits, lines a nd equipment of the Grantee to be constructed and maintained under, upon and across the premises of Gran':or in I,incoln County, State of Wyoming, along a line described as follows, to wit: BEING a portion of the SE1/4SW1/4 of Section 20, T37N, RI 18W, 6'~ P.M., Lincoln County. Wyoming more particularly descn-bed as follows: BEGINNING at a point that is S 74°31'26"E, 60.78 feet fi.om the SW Comer of Lot 9 of the Alpcndoff Subdivision Phase 2, Lincoln County, Wyoming, and running thence N74°51'28"E, 113.56 feet; Thence S 15°08'32"E 30 feet. Thence S74°51 '28"W 10.00 feet; Thence N15°08'32"W 20.00 feet; Thence S74°51 '28'Wi 93.61 feet; Thence S 14°52'14"E 20.00 feet; Thence S74°51'30"W 10.00 feet; Thence N 14052, 14"W 30.00 feet to the point of beginning, containing 1,536 square feet. EASEMENT to include a parcel: of ground 1536 square feet, together with all necessary and reasonable rights of ingress and egress and to: excavate and refill ditches and trenches for the location and repair of s;dd facilities and to cut, trim, spray herbicides, or remove trees, shrubbeTy, undergrowth or other obstmchcns interfering with the repair and maintenance of the facilities. The Grantor acknowledges that. Electric and Magnetic Fields (EMF) are naturally occurring in lhe transmission or distribution of electricity, and that the Grantee has here notified Grantor that F__aMF testi ag and information is available upon request from the Grantee. This Easement by Grantor is h~tendcd to include so much space as is necessary or appropriate to the presence of EMF and reasonable operation of the Grantee's disthbution lines. Grantor agrees that all poles, wires and other facilities, installed on or under the described lands shall remain the property of the Grantee removable in the sole discretion of the Grantee at the Grantee's expen The fights, conditions and provisions of this easement shall inure to the benefit of and be binding upon l he parties, their heirs, executors, adrrfinistrators, successors and assigns. Grantor shall compensate Grantee :.-'or any damages to Grantee's facilities caused by Grantor, including payment of Grantee's attorney fees if action is undertaken by Grantee to enforce the commitments descr/bed in this easement. Grant{ir resen'es the right to improve, occupy and use this easement for all purposes not inconsistent with the easement gra at. Each party shall have the remedy of specific performance regarding this easement. The fights and obhgafions described in this easement shall run with the land. This easement is not exclusive, m~d Gran':or retains all rights not specifically granted by th/s easement. Tiffs is the entire agreement of the part(es regarding this easement, except as may be set forth in writing after the date of this easement and signed by the parties.
