WERDER ) Xo O~ER ~4'oe On this 30th day of June, 2005, the above matter came on for heating before the Corn1, pursuant to phor assignment and order, on the petition of Albert Engel, seeking to have probate proceedings conducted in the Surrogate's Court of the State of New York, County of Kings in the estate of the above named Decedent admitted in this Court as a probate of said estate by this Court, and the Court having reviewed the file of record herein and being duly advised in the premises, makes the following findings: FINDINGS OF FACT That the certified copies of the proceedings had in the Surrogate's Court of the State of New York, County of Kings, as filed with the aforesaid petition are sufficient and in accordance with the requirements of § 2-11-201 W.S. That the aforesaid Decedent died seized of certain assets located in the County of Lincoln, State of Wyoming. That said assets were not in excess of a value of $150,000 at the date of death of the Decedent. 4. Those assets located in the State of Wyoming are as follows: Probate\Werder\Order Lot 56, Rees Subdivision, according to the official plat of record in the Office RECI=IVED 7/14/2005 at 4:02 PM RECEIVING # 909963 BOOK: 591 PAGE: 129 JEANNE WAGNER Lli']COLN COUNTY CLERK, KEMMERER, 0909963 of the Lincoln County Clerk, Lincoln County, Wyoming. 5. That duc and proper notice of these proceedings has been -i,,~n in accordance with § 2-11 201 W.S., and proof thereof by Affidavit of Publication is on file of record herein. 6. That there is on file of record herein a certificate showing no inheritance tax due, as issued by the Inheritance/Estate Tax Administrator of the Inheritance Tax Department of the State of Wyoming. 7. That no objections, written or oral, have been presented to the Court by any creditor of the Decedent, or by any other party whomsoever, to the admission of the aforesaid probate proceedings to record in this Court. Based upon the aforesaid, the Court makes the following: CONCLUSIONS OF LAW 1. That the Court has full and complete jurisdiction over the subject matter and all interested Parties in this cause. 2. That the file of record herein is complete and meets all the requirements of{} 2-11-201 W.S. for the relief prayed for in the petition. 3. That the Petitioner is entitled to relief as prayed for in the Petition heretofore filed herein. ORDER IT IS THEREFORE ORDERED, ADJUDGED AND DECREED that the certified copies of the proceedings in the estate of the above named Decedent had and conducted in the Surrogate's Court of the State of New York, County of Kings, as filed with Petitioner's petition herein, be in the same hereby are admitted to record in this Court. IT IS FURTHER ORDERED, ADJUDGED AND DECREED that said certified copies shall from this day forward be considered and treated as original proceedings in this Court and shall be Probate\Werder\Order conclusive evidence of the facts therein shown. IT IS FURTHER OP, DER_ED, ADJUnDGED A_Nq) DECREED that at the aforesaid date of death of the Decedent, the distributee entitled to this estate is: Name Share of Decedent's 'Estate in Wyoming Meredith Franco 100% IT IS FURTHER ORDERED, ADJUDGED AND DECREED that a certified copy of this order should be recorded in the Office of the County Clerk; and thereafter, the order and record thereof shall be presumptive evidence of title and authority to transfer title to the property herein described by Petitioner, Albert Engel.
