HomeMy WebLinkAbout91073100698 EASEMENT Sharon Sue Hatfield of Auburn, Lincoln County, Wyoming, grantor, for and in consideration of Ten Dollars ($10.00) and other valuable consideration, in hand paid, receipt of which is acknowledged, grants and conveys to Farrell Nield and Carol P. Nield, husband and wife, as tenants by the entireties, of PO Box 324, Afton, WY 83110, grantees, the following' described perpetual right-of-way easement for the following purposes: 1. Purpose of Easement. This easement is for the purpose of providing a perpetual non-exclusive 5-foot wide right-of-way easement for ingress and egress to the property described in paragraph 3 including the right to construct and maintain a roadway to provide that ingress and egress, and including the right to inspect the easement. 2. ConditiOns of this Easement. The conditions of this easement are: a. The easement may not be fenced by Grantees without the prior written consent of Grantor. b. By accepting or constructing a roadway in, using, or providing for or allowing any third parties to use the herein described easement, Grantees assume the risk of any and all damage including property or personal damage and agree to indemnify and hold Grantor harmless from any damage, whether property or personal arising from any such activities conducted by Grantees on or in the easement. 3. Property Benefited by Easement. This easement is for the benefit of the following described real property of the grantees in Lincoln County, Wyoming: Beginning at the Northwest Corner of Lot No. 1 in Block No. 17 of the Townsite of Afton, Lincoln County, Wyoming, and running thence East 5 rods; thence South 10 rods; thence East 5 rods; thence South 10 rods to the South boundary of said Lot No. 1; thence West along said South boundary, 10' rods, more or less, to the RECEIVED 8/9/2005 at 10:42 AM RECEIVING # 910731 1 BOOK: 593 PAGE: 698 ,JEANNE WAGNER LINCOLN COUNTY CLERK, KEMMERER, WY 00699 Southwest Corner of said Lot No. 1; thence North along the West boundary of said Lot No. 1, 20 rods, more or less, to the point of beginning. 4. Description of Easement. The easement is described as follows: Beginning at a point in the North boundary line of Lot No. 1 in Block No. 17 of the Townsite of Afton, Lincoln County, Wyoming, that is 5 rods East of the Northwest Corner of said Lot No. 1, and running thence South along the East boundary of the Farrell Nield and Carol P. Nield tract described in Paragraph 3 above, 10 rods; thence East along a North boundary of said Nield tract, 5 feet; thence North parallel to said East boundary 10 rods, more or less, to the North boundary of said Lot 1; thence West along said North boundary, 5 feet, more or less, to the point of beginning. 5. Binding Effect. The terms and conditions of this easement shall be binding upon and inure to the benefit of the heirs, successors in interest and assigns of the parties named in this instrument. 6. Waiver of Homestead Rights. The Grantor hereby waive and release all rights to the described easement under and by virtue of the homestead exemption laws of the State of Wyoming to the extent that such rights may interfere with the purposes of this easement.
