That the undersigned, Ralph W. Hayes ired Cl~andra M. Hayes, husband and wife as Tenants by the
Entireties, ("Grantor") for a good and valuable consideratlor~ the receipt of which ~s herct~,
acknowlc6gcd, do hereby grant, convey and warrant umo Lower Valley Energy, a Cooperative Corporatioa,
of Aflon and Jacl~on, Wyoming and to its su~ccssors and assigns, ("Grantees"), a pa'petual easeraem avid
fight of way for thc constngtion and continued main~ancc, repair, altcra~on and rcplaccracnt of
electric dis~bution circuits, lines and CClUi~ of thc C_rnmtee m be consUucted and maintained under,
upon and across the premises of Grantor in Lincoln Couaty, State of Wyoming, along a line de. scribed ~s
follows, to wit:
BEING a part of River Fishing and Equestrian Estates, Lot 7, Section 22, T35N, RI 19W, in Linco'n
County ,Wyon~ng more accurately 6csvribed as follows:
BEGINNING at the location that sq.'ares Lot l and Lot 7 at the wcst end of thc vul<lc-sa~.

EASEMENT to include 10 feet on each side of ~scribcd line, together with all necessary and reasonable
rights of ingress and egress and to excavate and refLll ditches and trenches for the location and repair of sa: d
facilities and to cut, aim, spray h~rbi¢ides, or remove frees, shrubbery, undergrowth or other obstructimis

Thc Grantor acknowledges that Electric and Magnetic Fields (EMF) are naturally occurring in the
mmsmission or dism~oution of electricity, and that the Grantee has hcrc notified G-t~tor that F2vtF tcstir g
and information is available upon request from tl'g Grant~. This Easement by Cwantor is intended ,~
h~lud~ so mu~h space as is necessary or appropriat~ to thc pre. s~nce of EMF and reasonable upc~afion ,ff
thc Cmm~ec's distribu~on lines.
Grantor agrees that all poles, wires and other facil'nies, install, cd on or under the dcs~n'bed lands slull
remain thc property of thc Ca-antee removable in the sole discretion of the Grantee at the Crzantcc's expense.
Thc rights, conditions and provisions of this casement shall inure to the benefit of and be binding upon the
parties, their heirs, cxccuta~s, administrators, successors and assigns. Grantor shall con~ponsate Grantee t~r
any damages to Grantee's facilities caused by C-rimtor, including payment of Grantee's attorney fccs if
action is tmdcrtak~ by Grantee to cnfor~ thc coramitmc~ts described in this cascn~nt. Grantor rcscr~m
thc right to improve, (r, cupy and use this casement for all purposes not inconsistent with the casement gra~.t.
Each party shall have the rcmcdy of specific performance rcgarding this easemonL The rights a~l
obligations dcscribcd in this cascn~nt shall run with the land. This easement is not exclusive, and Cn'ani))r
retains ali rights not specifically granted by this eas~*mcnt. This is LI~ entire agreement of thc parti,:s
regarding this easement, except as may be set forth in writing after the date of this easement and signed
thc parties. Grantor hereby releases and waives all rights by virtue of tl~ Homestead Exemption Laws of
Wyoming.
