The undersigned, having been duly sworn, hereby deposes and says as follows:
1. That my name is Nancy Blakley, and I am currently employed as a title officer by
Reliable Title & Escr°w, and myj0b responsibilities include title searches and examinations.
2. That the following described property was conveyed to JOHN LEGARRA,
RAMONA VANCE, STANLEY LEGARRA and ROBERT LEGARRA, in that Warranty Deed
which appears of record in Book 256PR at Page 195, No. 679881, and recorded October 22,
1987, records of Lincoln County, Wyoming. See Exhibit A attached hereto and made apart
hereof by this Reference.
3. That there is a typographical error in the Conveyance said Warranty Deed, it shows
BERTH LEGARRA when it should have showed BERTHA LEGARRA.
4. That the correct legal descriptiOn in that Warranty Deed appearing of record in Book
256PR at Page 195, No. 679881, and recorded October 22, 1987, reCords of Lincoln County,
Wyoming should now be described as follows:
The Easterly Fifty-Four Feet of Lots 1 and 2, Block 5 of the Original Townsite of the Town of
Kemmerer, Wyoming, more particularly described as follows, to-wit:
BEGINNING at the Southeasterly corner of said Lot 1, at theintersection of the Westerly side of
the alley of Block 1 and the Northerly side of Pearl Street, thence South 63026, West 54.00 feet;
thence North 26034, West 100.00 feet; thence North 63026, East 54.00 feet; thence South 26034,
East 100.00 feet to the point of BEGINNING; containing 5400 square feet.
Subject to all existing easements, reservations, and right-of-ways now of record in the office of
the County Clerk of Lincoln County.
Excepting and reserving unto Grantor, herein, an easement and right-of-way over, upon and
across the Northeasterly portion of the said Lot 2 of Block 5, and more particularly being
described as folloWs to-wit: Commencing at the Northeasterly corner of said Lot 2, thence .
Westerly along the said Northerly boundary line of said Lot a distance of 54 feet, thence
Sou. thwesterly a distance of 12 feet to a point, thence Easterly at right angles a distance of 54 feet
to the Easterly boundary line of said Lot 2, thence Northerly along said boundary line of said Lot
2 a distance of 12 feet to the point of beginning; said easement and right-of-way shall be for the
purpose of permitting the Grantor herein to make coal deliveries to the property of Grantor which
is located on said Lots 1 and 2 of said Block 5. Said easement and right-of-way shall remain in
full force and effect for so long as Grantor requires the same for such coal deliveries.
5. That this affidavit is made in conformance with Wyoming Statue 34-11-101.
On the 2 day of September, 2005, personally appeared before me Nancy Blakley,
the signer of the foregoing instrument, wh~~y acknowledges to me that she executed
