DISTRIBUTION EASEMENT
KNOW ALL MEN BY THESE PRESENTS:
That WE, the undersigned, acting for and on behalf of MARVIN LEE SCHWAB, as tenants by
the entireties, ("Grantor"), for a good and valuable consideration, the receipt of which is hereby
acknowledged, do hereby grant:, convey and warrant unto Lower Valley Energy, a Cooperative
Corporation, of Afton and Jackson, Wyoming and to its successors and assigns, ("GTantees"), a
perpetual easement and right of way for the construction and continued maintenance, repair,
alteration and replacement ofthe natural gas distributions system and electric ilistribution
circuits, lines and equipment of the GTantee to be constructed and maintained under, upon and
across the premises of Grantor in LINCOL'!\! COUNTY, State of 'NYOMNG in an area
described as follows, to wit:
Being a part of Lats 4 & 5 oft11.e Twin Cliff Subdivision, Section 18, T32N, Rl18\V, LincoJn
County, Wyoming,
Commencing at a point being the SW comer of said Lot 4; thence easement begins and bears N
11 degrees E, 498 feet; thence N I degree E, 575 fee,; thence N 65 degrees E, 50 fe·e'!.
EASEME:-IT to include 7,5 feet on each side of described line.

Together ~ith all necessary and reasonable rights of ingress and egress and to excavate and refill
ditches and trench for the location and repair of said facilities and to cut, trim, or rcmove trcc:s,
shrubbery, undergrowth or other obstructions interf"ring with the repair and maintenance of t:le
facilities. The GTantor acknowledges that Electric arid magnetic Fields (EMF) are naturally
occuning in the distribution of electricity, and the Grantee has here norified Grantor that EIvIF
testing and infonnatíon is available upon request from the Grantee. The undersigned abrrees tbat
a11 ~ires and other facilities, installed on the above·rlescribed lands at the Grantee's expf.l1Se shall
remain the property of the Grantee, removable at the option of the Grantee, We hereby release
and waive all rights under and by virtue of the Homesteed Exemption Laws of the said State,

MARVIN LEE SCHWAB, being first duly sworn upon his oath, deposes and states
as follows:
1. On or about the 23rd day of December, 2004, my wife, Terri Lynn Schwab, died
as is evidenced by the official certificate of death attached hereto as "Exhibit A"and
incorporated herein by this reference.
2. At the time of her death she jointly owned an interest in certain real property
with me, said real property being located in the County of Lincoln, State of Wyoming,
and more particularly described as follows:
Lot 4 of Twin Cliff Subdivision, Lincoln County, Wyoming,
according to that plat of record in the Office of the Lincoln
County Clerk.
Subject to reservations and restrictions contained in the United States
Patent and to easements and rights-of-way of record or in use.
Together with all improvements and appurtenances thereon.
3· Said real property interest was originally conveyed to Marvin Lee Schwab and
Terri Lynn Schwab, husband and wife, as tenants by the entireties, with right of
survivorship, bya Quitclaim Deed dated JUl1e 20, 1996, and recorded July 1, 1996, in the
Office of the Lincoln County Clerk and Ex-Officio Register of Deeds in Book 385 of P.R.,
Page 55, Instrument No. 822221.
4· By reason of my wife's death, I am entitled to sole ownership of the interest 'in
and to the above-mentioned real property.
