",',-.-,1.'''',',',' ,-~ 00 65 t7 DECLARATION OF RESTRICTIVE COVENANT THIS DECLARATION is made by Pamela J. Hruska and Randy J. Hruska, Trustees, or their successors in trust, under the Pamela J. Hruska Living Trust dated June 11, 1991, as to an undivided one-half (1/2) interest, and by Randy J. Hruska and Pamela J. Hruska, Trustees, or their successors in trust, under the Randy J. Hruska Living Trust dated June 11, 1991, as to an undivided one-half (1/2) interest, as tenants in common (" De cia rants"), of 400 North Center Street, Rock Springs, Sweetwater County, Wyoming 82901, the owners of the following described real property located in Lincoln County, Wyoming ("the Property"): , I I NE1/4, W1/2SE1/4. and Lots 2 and 3 of Section 7; NW1/4NE1/4 (Lot 2) of Section 18; SW1/4 and W1/2SE1/4 of Section 5; Lots 1, 2, 3 of Section 8; and the following described tract of land: commencing at a point which is the Northeast Comer of the SE1/4SE1/4 of Section 6 and running thence South 80 rods, thence West 80 rods, thence in a Northeasterly direction to the point of beginning;al being in 131N, R119W, 6th P.M., Lincoln County, Wyoming. The Property is of high scenic, natural and esthetic value. Therefore, to preserve and maintain the scenic beauty, natural character and esthetic value of the Property, Declarants hereby declare that the Property shall be held, sold and conveyed subject to the following perpetual restrictive covenant which shall run with the Property and be binding on all parties having any right, title or interest in the Property or any part thereof, and their heirs, successors, and assigns: The Property may not be divided or subdivided into separate tracts of land less than 35 acres in size. If the Property is ever divided into separate tracts, no buildings may be constructed on each such resulting separate tract except one (1) single family residence with one (1) attached garage and one (1) separate storage building. If this restrictive covenant is ever violated, in addition to any other remedy provided by law, any person injured by such violation may bring an action in court to enjoin such violation, and if successful, recover all costs and expenses of doing so including a reasonable attorney fee.
