DISTlUBUTJON EASEMENT
KNOW ALL ìvlEN BY THESE PRESENT:
That the undersigned, DAVID LOMELI & STEPHANIE tvl A RIE LOMELI, huslxlI1d &. wife ("GLlIllor")
for a good and valuable consideration, the receipt of which is hereby acknowledged, do hereby grant,
convey and warrant unto Lower Valley Energy, a Cooperative Corporation, of Anon ¡lI1d Jackson,
\Vyoming and to its successors and assigns, ("Gr,lIllees"), a perpelllal easement and right of way for the
construction and continued maintenance, repair, alteralion and replacement uf the electric distribution
circuits, lines and equipment of the Grantee to be construcll:d and mainlained uncler, upon and across the
premises of Grantor in Lincoln County, State of Wyoming, along a line descrihed as follows, to wit:
BEING a part ufLot 28 of the Shadow Dancer Estate Subdivision, Lincoln County, Wyoming.
COMMENCING at a point heing the NOrlhern most corner of said Lot 28: thence S 30 degrees E, I ()' to a
vault; thence easement beings and bears S 37 degrees W, 125 feel; thence N 85 degrees W, 75 feet; lhence
N 5 degrees W 23 feet, to a transformer; thence S 47 degrees E, 20 feet to a meter.
RIGHT-OF-WAY \Vidth 7.5 feet on each side of described line, together with all necessary and reasonable
rights of ingress and egress and to excavate and refil1 ditches and trenches for [he location and repair of said
facilities and to cui, trim, spray herbicicles, or remove trees, shrubbery, undergrowth or other obstructions
interfering with the repair and maintenance of the facilities.
The Grantor acknowledges that Electric and t\1agnetic Fields (EMF) are naturally occurring in the
transmission or distribution of electricilY, amllhat the Grantee has here nOlified Grantor [hat EtvlF testing
and informalion is available upon request from lhe Grantee. This Easement by Grantor is intended to
include so much space as is necessary or appropriate 10 the presence of EtvlF and reasonable operalion of
the Granlee's distribution lines.
Grantor agrees that all poles, wires and other facilities, installed on or under the described lands shall
remain the property of the Grantee removable in lhe sole discretion of the Grantee at the Grantee's expense.
The rights, conditions and provisions of this easement shall inure to the benefit of and be binding upon the
parties, their heirs, executors, administrators, successors and assigns. Grantor shall compensale Cìrantee for
any damages to Grantee's facilities caused by Grantor, including payment of Grantee's attorney fees if
action is undertaken by Grantee to enforce lhe commitments described in this easernent. Grantor reserves
the right to irnprove, occupy and use this easement for all purposes nol inconsistent with the easement grant.
Each party shall have the remedy of specifIc performance reg~lrding this easement. The rights and
obligations described in this easement shall run wilh lhe land. This easement is not exclusive, and Grantor
relains all rights not specifically granted by this easement. This is the enllre agreement of lhe parties
regarding this easement, excepl as may be set forth in writing after the date of lhis ease men I and signed by
the parties. Grantor hereby releases and waives all rights by virtue of the Homestead Exemption Laws of
Wyoming.
