DISTRIBUTION EASEl\IENT
That Úle undersigned, Jason C. Anderson and Julle E. Anderson, husband and wife, as tenants by tlie
entireties, ("Grantor") for a good and valuabJe consideration, the receipt of which is hereby acknowledged,
do hereby grant, convey and warrBIlt unto Lower VaHey Energy, a Cooperative Corporation, of Afton atld
Jac.kson, Wyoming and to its successors and assigns, ("Grantees"), a perpetual easement and right of way
for the construction and continued maintenance, repair, alteration and replac.ement of th~ eleeu-ic
distribution circuits, lines and equipment of the Grantee to be constructed and maintained lmder, upon and
across the premises of Gr.u¡tor in Uncoln County, State of Wyoming, 'along a line described as foHows, :0
wit:
BEING a portion of lot 2 of the CMR Subdivision, Section 23, T35N, R 119W, in Lincoln County
,Wyoming more particularly described as folJows:
BEGIJ\'NING at a point being the SE Comer of ssid Lot 2 at an existing junction vault
Thence N 18° W, 132 feet to a transfomler location.
EASEMENT to include 10 feet on each side of described line, togetl¡er with aH necessary and reasonable
rights of ingress and egress and to exca vate and refill ditches and trenches for the location and repair or sa id
faeiJitics anò to cu~ trim, spray herbicides, or remove trees, shrubbery, unòcrgrowth or other obstructions
interfering with the repair and maintenance of the facilities.
The Grantor acknowledges that E1ectric and Magnetic Fields (EMF) are natur.illy occurring in Ule
transmission or distribution of electricity, and that the Grantee has here notified Grantor that FJvfF testiJlg
and infonnation is available upon request fÌom the Grantee. This Easement by Grantor is intended [0
include so much space as is necessary or appropriate to the presence of EMF and reasonable operation ,)f
the Grantee's distribution lines.
Grantor agrees that all poles, wires and other faciJities, in~ned on or illlder the described lands sh¡JI
remain the property of the Grantee removable in the sole discretion of the Grantee at the Grantee's expeme.
The rights, conditions and provisions of this easement shall inure to the benefit of and be binding upon the
parties, their heirs, executors, administrators, successors and assigns. Grantor shaH compensate Grantee f)r
any damages to Grantee's facilities caused by Grantor, including payment of Grantee's attorney rees if
action is tmderta1œn by Grantee to enforce the commitments described in this easement. Grantor reserv~s
the right to improve, occupy and m;e this easement for all purposes not inconsistent with the easement graIl!.
Each party shan have the remedy of specific performance regarding this easement. l1a: rights alld
obJigations described in this easement shall run with the land. This easement is not exclusive, and Granbr
retains all rights not spL'Cifieally granted by this easement. This is the entire agreement of the parti ~s
regarding this easement, except as may be set forth in Wliting after the date of this easement and signoo hy
the parties. Grantor hereby releases and waives all rights by virtue of the Homestead Exemption Laws )f
WYO!IÙng.
