DISTRIBUTION EASEMENT
KNOW ALL MEN BY THESE PRESENT:
That the Wldè'csigned, Marianne'Schmit llclJaucr, Trusteee of the Mortensen Family Trust datt:d
September 19, 2000; and Lance Mortensen and Lori Mortensen as tenants in Commo:n, ("Grantor")
for a good and valuable consider.ation, tile receipt of which is hereby acknowledged, do hereby grallt,
convey and warrant unto Lowe:(, VaHey Energy, a Cooperative Corporation, of Afton and Jackson,
Wyoming and to its successors and assigns, ("Grantt:es"), a perpetual easement and right of way for the
construction and continued mainienance, repair, altèration and replaciemcnt of the ëkctric distributic'fi
circuits, lines and equipment of the Grantee to be constructed and rnaintained undt::r, upon and across tile
premises of Grantor in Lincoln County, State ofWyomJng, along II line described as follows, to wi!:
BEING a portion of GLO Lot :2, Section 28, T36N, R119W, in Lincoln COlffity, Wyoming mOJ'e
particularly described as follows:
BEGINNING at a point 510 feet nom of the SW comer of said GLO lot 2 at a junction vault location.
Thence N 70oE, 370 feet to a juncti~n vault location; thence N 16°E, 144 feet to a transfo= location.
EASEMENT to include 10 feet on each side of described line, together with all necessary and œasonabJe
rights of ingress and egress and to excavlite and refill ditches and trenches for the location and repair of said
facilities and to cut, trim. spray herbiL;des, or rolTlDve trees, shrubbery, undergrowth or other obstructior 5
interfering with tile repair and maintenance of the facilities.
The Grantor acknowledges that Electric and Magnetic Fields (EMF) are naturally occurring in the
transmission or distribution of electricity, and that the Grantee has here notified Grantor that EMF testing
and information is available upon,roquest from the Grantee_ Ths Easement by Grantor is intended tJ
include so much space as is neceS&ary or appropriate to the presence of EMF and reasonable operation (f
the Grantee's distribution lines.
Grantor agrees that all poles, wir~s and other facilities, insælled on or under the describ"d lands aha: I
remain the property of the Grantee removable in the BOle dis(:retion of the Grantee at the Grnntec's expenSI'.
1ñe rights, conditions and provisions of this easement iihall inw-e to the benefit of and be binding upon th:
parties, their heirs, executors, administrators, successors and assigns_ Grantor shaH cOl11p<:11sate Grantee for
any damages to Grantee's facilities caused by Grantor, including payment of Grantee's attorney fees jf
action is undertaken by Grantee to enforce the commitments œscribed in tJùs easement. Grantor reserves
the right to improve, occupy and use tJùs easement for aU purposes not inconsistent with thc easement gran:.
Each party shall have the remedy of specific performance regarding this east:fficnt. The rights ani
obligations described in this easement shall run with the land. This easement is not exclusive, and Grantor
retains all rights not specifically granted by this easement. This is the entire agreement of the parties
regarding this easement, except as may be set forth in writing after the date of this easement and signed h'ý
the parties. Gr-dIltor hereby releases and waives all rights by virtue of the Homestead Exemption Laws of
Wyoming.
