T35N, R1l9W DISTRIBUTION EASEl"ffiNT KNOW ALL MEN BY THESE PRESENT: That the undersigned, J.B. Inve~tments, LLC, a Wyoming Limited Liability Company, % Ja]w Hanson, P.O. Box 11725, Jackson, WY 83002, ("Grantor") for a good and valuable consideration, the receipt of which is hereby acknowledged, do hereby grant, convey and warrant unto Lower Valley Ener!:,')', a Cooperative Corporation, of Afton and Jackson, Wyoming and to its successors and assigns, ("Grantees"), a perpetual easement and right of way for the construction and continued maintenance, repair, alteration arid replacement of the electric distribution circuits, lines and equipment of the Grantee to be constructed arid maintained under, upon and across the premises of Grantor in Lincoln County, State of Wyoming, along a line described as foHows, to wit: BEING a portion of the NWl/4SWl/4 of Section 11, T35N, R119W, 6th P,M, in Etna, Lincoln Countý, Wyoming and being amore particularly described as follows. BEGINNING at a point 538.36 feet south and 60.49 feet east of the West quarter comer of said Section I!; Thence S 89° 41' 13" E, 25 feet to a point. Easement to include a strip of ground 20 feet in width nmning paral1el with north line of parcel 1 as described in exhibit "A" as recorded in the office of Clerk, Kemmerer, Wyoming, Book 566 PR page 247. EASEMENT to include 10 feet on each side of described line, together with all necessary and reasonable rights of ingress and egress and to excavate and refill ditches and trenches for the location and repair of sai d facilities and to cut. trim, spray herbicides, or remove trees, shrubbery, lmdergrowth or other obstructiors interfering with the repair and maintenance of the facilities. The Grantor aclmowledges that Electric and Magnetic Fields (EMF) are naturally occuning in the transmission or distribution of electricity, and that the Grantee has here notified Grantor that EMF testin g and infommtion is available upon request from the Grantee. This Easement by Grantor ls in1emled b include so much space as is necessary or appropliate to the presence of EMF and reasonable opt:ration ( f the Grantee's distribution lines. !a q Grantor agrees that all poles, wires and other facilities, installed on or under the described lands sha'l remain the property ofthe Grantee removable in the sole discretion of the Grantee at the Grantee's expense:. The rights, conditions and proyjsions of this easement shall inure to the btnefit of and be binding upon th;: parties, their heirs, executors, administrators, successors and assigns. Grantor shall compensate Grantee for any damages to Grantee's facilities caused by Grantor, including payment of Grantee's attorney fees jf action is undertaken by Grantee to enforce the commitments described in this easement. Grantor reserves the right to improve, occupy and use this easement for all purposes not inconsistent with the easement gratL Each party shall have the remedy of specific perfOlmance regarding this easement. The rights an,i obligations described in this easement shall run with the land. TIlis easement is not exclusive, and Grantor retains all rights not specifically granted by this easemtnt. This is the entire agrl.:cment of the parties regarding this easement, except as may be set forth in writing after the date of this easement and signed by the parties. Grantor hereby releases and waives al1 rights by virtue of the Homestead Exemption Laws cf Wyoming.
