KNOW ALL MEN BY THESE PRESENT:

('"Grantor") for a good and valllab]e consider¡¡tion, thè receipt of whi.:h is héreby acknowledged, do hereby
grant, convey and warrant unto Lower Va]]ey Energy, a Cooperative COIvoration, of .:\non and Jackson,
\Vyoming ¡¡nd to its successors and assigns, ("Grantees"), a perpetual easement and right of way for the
constnlction and continued maintenance, repair, alteration and replacemént of the electric distfJ[¡ution
circuits, lines and equipment of the Grantee to be constructed and maintained under, upon and across the
premises of Grantor in Lincoln County, State of 'Vyomillg, along a line described as lèJllolVs, to wit:
BEING a portion of Tract 3 of De]] Creek Ranches, Section 15, T36N, R119W, in Lincoln County
,Wyoming more accurately described as fo]]ows:
BEGINNING at a point being the SF corner of said Tract 3.
Thence N 87° 39'35" W, 36 feet to a transfoll11er location. Easement to include a strip of land 20 feet in
width running paralkl with south line of said Tract 3.
EASEIVLENT as described above together with all necessary and reasonable rights of ingress and egress and
to excavate and refi]] ditches and trenches for the location and repair of said Ülcllities and to cut, trim, spray
herbicides, or remove trees, shrubbery, undergrowth or other obstructions interfering with the repair and
maintenance of the facilities.
The Grantor acknowledges that Electric and Magnetic Fields (EMF) are natura11y occurring in the
transmission or distribution of electricity, and that the Grantee has here notified Grantor that EMF testing
and infonm1tion is available upon request from the Grantee. This Easement hy Grantor is intended to
include so much space as is necessary or appropriate to the presence of EI\IF alld reasonable operation of
the Grantee's distribution lines.

Grantor agrees that a11 poles, wires and other faciJities, insblled on or under the descrihed bnds skill
remain the property of the Grantee removable in the sole discretion of the Grantee at the Grantee' ~ expense.
The rights, conditions and provisions of this easement sha11 inure to the benefit of and be hll1cling upon the
parties, their heirs, executors, administrators, successors and assigns. Grantor shall compensate Grantee for
any damages to Grantee's tàcilities caused by Grantor, including payment of Grantee's attorney fees 1 f
action is undertaken by Grantee to enforce the commitments described in this eas("menl. Grantor reserves
the right to improve, occupy and use this easement for all purposes not inconsistent with the easement grant.
Each party sha11 have the remedy of specitìc perfol111ance regarding this easement. The rights and
obligations described in this easement sha11 run with the land. This easement is not e..xclusive, and Crantor
retains a11 rights not specifically granted by this easement. This is the entire agreement of ¡he parties
regarding this easement, except as may be set forth in writll1g after the date of this easement and sIgned by
the parties. Grantor hereby releases and waives a11 rights by virtue of the Homestead Exemption Laws of
