Ray and Hope Ray, husband and wife, as tenants by the eutiretil's, ("Grantor") for a good and valuable consideration, the receipt of which is herc:by aCKnow1edged, do hereby grant, convey and warrant unto Lower Valley Energy, a Coo!ìc:rative Corporation, of Anon and Jackslm, \Vyoming and to its successors and assigns, ("Grantees"), a perpetual easement and right of way for the construction and continued maintenance, repair, alleration and replacement of the electric distribution circuits, IlI1es and equipment of the Grantee to be constructed and maintained under, upon and across the premises of Grantor 111 Lincoln County, State of "'yoming, along a linc: described as fo]]ows, to wit: BEING a pOliion of Tract 3 of De]] Creek Ranches, Section ] 5, T36N, R] 19W, in Lincoln County ,Wyoming more accurately described as fo]]ows: BEGINNING at a point being the 8E conwr of said 'fract 3. Thence N 87° 39'35" W, 36 feet to a transformer location. Easement to include a strip of lanel 20 feet in width running paralle] with south line of said Tract 3. EASEMENT as described above logether with a]] necessary and reasonable rights of ingress <1nd egress and to excavate and reti]] ditches and trenches for the loc¡¡tion and repair of s,ml facilities and to cut, trim, spray herbicides, or remove trees, shrubbery, undergrowth or other obstructions interfering with the repair and maintenance of the facilities. The Grantor acknowledges that Electric and Magnetic Fields (EMF) are naturally occurring 111 the transmission or distribution of electricity, and that the Grantee has here noti1ied Grantor that EfvlF testing and information is available upon request tì-om the Grantee. This Easement by Grantor is inkn,k-d to include so much space as is necessary or appropriate to the presence of El'v!F and reasonable operation of the Grantee's distribution Jines. Grantor agrees that all poles, wires ane! other facilities, installed on or under the descrihed lands sha]] remain the propert-y of the Grantee removable in the sole discretion of the Grantee at the Cìrantn"s expense. The rights, conditions and provisions of this easement shall inure tn the bene1it of and be binding upon the Î ') parties, their heirs, executors, administrators, successors ;1J1d assigns. Grantor shal1 compens,Itc CìulI1lee for v any darnages to Grantee's facilities caused hy CJranlor, including paymènt of CìniJItee's attorney fees if actIon is undertaken by Grantee to enforce the commitments described in this easement. Cìrantor reserves the right to improve, occupy and use this easement for all purposes not inconsistent with the l>asem(' \l grant. Each party shall have the remedy of specific performance regarding this easement. The rights and obligations dcscribèe! in this easement shaH run with the land. This easement is not exclusive, and Grantor retains aH rights not specifically granted by this easement. ThIs is the entire agreement of thl' parties regarding this easement, except as may he set torth in writing after the dale of this easemult and signed by the parties. Grantor hereby releases and waives all rights by virtue of the Homestead Exemption Laws of \Vyommg.
