Comes now Paul N. Scherbel of Big Piney, County of Sublette, State of Wyoming, who, being
duly sworn on oath according to Imv, does hereby make the Ü)llowing statement of Ülcts and
affirm:
1. That he is a Professional Lane! Surveyor registered under the laws of the State of Wyoming
with Registration Number 164 dated 15 September 1951.
2. That he is very familiar with the idiosyncrasies of the surveys for the Townsite of Tulsa and
the Town of LaBarge, Lincoln County, Wyoming through his many years of surveying
practice in the Town and adjoining area.
3. That Winton II. Alleman, Trustee of "Tl-lE WINTON ALLEîvlAN TRUST" dated the 15th
day of May 1984 granted by Warranty Deed on 23 August 1995 to grantee DANIEL J.
SC1IlvlID AND NANCY M. SCHIVIlD, Husband and wife, as tenants by the Entireties, the
following described lands:
"All of Lincoln County Lot 12 in Section 5, Township 26 North, Range I ] 2 West of the 6th
P.M., Lincoln County, Wyoming, containing 19.42 acres, more or less", which is of record in
the Office of the Clerk of Lincoln County in Book 372 of Photostat ice Records on page 825.
4. That Lincoln County Lot 12 is not in Section 5, T26N, JU 12W but actually is in Lot 8 of
Section 6, T26N, R 112W and is depicted upon that plat of record in said Office as Plat No,
24, titled, "Lincoln County Metes & Bounds Plat No, 2" dated 11 January 1940.

5, That the lanels in Section 5 as granted to the grantees should read:

Range 112W of the 6th P,M., Lincoln County, Wyoming, containing 19.42 acres, more or
less.
6. That this aHidavit is made of public record to preclude any confusion as to the lands actually
granted to said grantee.
