AFFIDA VIT OF SUCCESSOR TRUSTEE
Clifton Max Amundsen, being first duly sworn upon oath, deposes and says that Clifton Max
Amundsen is the Successor Trustee under the Trust known as the Max R. Amundsen Trust, dated
May 23, 1990, as amended, by virtue of the death of Max R. Amundsen, the initial Trustee of said
Trust, the Death Certificate of which is attached hereto, by virtue of said Trust which was amended
on April 10, 1998, which states as follows:
THIS AMENDED TRUST AGREEMENT is made this 10 day of April, 1998, between Max
R. Amundsen of Bountiful, Utah, hereinafter sometimes called the "Trustor" and Max R.
Amundsen, hereinafter sometimes called the "Trustee". This Agreement amends the Trust
Agreement dated May 23, 1990.
Trust does hereby transfer to the trustee Ten Dollars ($10.00) and the Trustee agrees to hold
such property and any other property added to this Trust on the terms and conditions stated
herein. Trustor or any other person or persons may add such other property to the trust
property as may be acceptable to the Trustee by either inter vivos or testamentary transfer;
and such additional property when delivered to the Trustee shall become a part of the Trust
and be held by the Trustee on the terms and conditions stated herein.
7.5 Resignation: The Trustee may resign at any time by giving thirty (30) days written notice
to Trustor, or, after the death of Trustor, to all of the then current, adult, competent
benetìciaries of this trust. Upon such notice or upon the death or inability to service of the
Trustee, Trustor, or after the death of Trustor, a majority in number of the then current adult,
competent beneficiaries of this trust ¡nay appoint a successor trustee. If no such appointment
is made within thirty (30) days after such event, then the District Court of Davis county or
any judge thereof may appoint a successor trustee upon application of the resigning Trustee
or of any other interested party. Notwithstanding the above, the initial successor trustee shall
be Clifton Max Amundsen. If Clifton Max Amundsen refuses to accept appointment, or
dies, or becomes incapacitated, or resigns, or for any reason otherwise fails to serve as
Trustee, then Trustor appoints Katherine A. Kunkel as Successor Trustee.
The undersigned hereby serves notice that Clifton Max Amundsen in his capacity of
Successor Trustee under certain trusts know as the Max R. Amundsen Trustdated May 23, 1990 as
amended, assumes title to the real and personal property covered by said Trust and the family trust
provision contained therein, including, but not limited to, the following described real property:
Lot 7, Plat 15, in Star Valley Ranch,
Together with all improvements thereon and appurtenances there unto belonging.
