NOTICE OF LIS PENDENS
Pursuant to Wyoming Statute §1-6-107, notice is hereby given that on December 19,
2005, Ja~_H. Dorsey, III ("the Buyer"), as Plaintiff, filed a Complaint in the United States
District Court, Cheyenne, Wyoming, against Kenneth J. Counts ("Counts") and Eleanor S.
Rosberg ("Rosberg"), as Defendants. The litigation is docketed as Civil Action No. 05-CV-
317D.
In the litigation, the Buyer seeks to enforce a November 17, 2005 Contract to purchase
\
real property located in Alpine, Wyoming owned by Counts and Rosberg. The Buyer seeks to
require Defendants to perfomI their obligations under the Contract, specifically by requiring
Defendants to c10sethe transaction contemplated by the November 17, 2005 Contract.
Title to the following real property is either the subject matter of or is affected by the
above-referenced litigation:
Lot 53 of the Alpine Village Subdivision No.1, Plat 3, Amended, as filed and
platted in the Lincoln County Clerk's office in Kemmerer, Lincoln County,
Wyoming.
