and utilities, together with the right to construct, improve, maintain and use the same
without liability for damages, if any.

EXCEPTING AND RESERVING unto Seller all minerals, mineral rights, oil, gas, liquid
hydrocarbons and all other valuable ores, "substances and deposits of every kind and
description whatsoever, in or under the surface of the above-described lands, including

SUBJECT to all mineral leases, reservations, restrictions, protective covenants,
