Stephen K. Smurthwaite aka Stephen Smurthwaite, of 14492 Garden Trail, San Diego, CA
92127. upon his oath deposes and says:

1. That he makes this affidavit as his recorded statement, duly verified, pursuant to the
provisions of W.S. 34-2-123 and in connection with the following described real property located in
Lincoln County, Wyoming:
Lot Seventy-Four (74) in Star Valley Ranch Plat Nine (9) as platted and recorded in
the official records of Lincoln County, Wyoming.
2. That the name of the grantee in that Quit Claim Deed dated June 19, 1984, and
recorded in the office of the Lincoln County Clerk on September 19, 1994, in Book 357 PRo page
515, Recording No. 789954, conveying the above-described real property is hereby stated to be as
follows: Norma W. Smurthwaite, as trustee under that certain Inter Vivos Trust Agreement of May
7, 1984, between said Konrad E. Smurthwaite as Trustor, and Norma W. Smurthwaite as trustee.
The beneficiaries of this trust are Susan Smurthwaite Richards, Karen Smurthwaite Goodwin
Mason, Kim Smurthwaite, and Stephen K. Smurthwaite.
3. That his name and address are Stephen K. Smurthwaite. 14492 Garden Trail, San
Diego, CA 92127.
4. That he is the son of Norma W. Smurthwaite and a beneficiary of the trust referred
to, that Norma W. Smurthwaite became deceased on January 1, 2006, that upon the death of
Norma W. Smurthwaite, Susan Smurthwaite Richards, Karen Smurthwaite Goodwin Mason, Kim
Smurthwaite, and he became the Successor Trustees under that certain Inter Vivos Trust
Agreement of May 7, 1984, between Konrad E. Smurthwaite as Trustor, and Norma W.
Smurthwaite as trustee.

5. That as of January 1, 2006, the date of death of Norma W. Smurthwaite, Susan
Smurthwaite Richards, Karen Smurthwaite Goodwin Mason, Kim Smurthwaite, and Stephen K.
Smurthwaite became the Successor Trustees under that certain Inter Vivos Trust Agreement of
May 7, 1984, between Konrad E. Smurthwaite as Trustor, and Norma W. Smurthwaite as trustee,
including its ownership of the real property described above, and that they are currently lawfully
serving in that capacity.
6. That he hereby verifies that the information contained in this affidavit is true and
correct according to his information and belief.
