Box 3649, Wilmington, North Carolina 28406 and LOTT Partnership II of P.O. Box 38, Candler, North Carolina 28715 (Grantees), the following described perpetual right-of-way easement for the following purpose and under the following conditions: (1) Purpose of Easement. This easement is for the purpose of providing a perpetual right-of-way easement sixty feet in width for a private access for ingress and egress to the property described in paragraph 3, including the right to construct and maintain a roadway to provide that ingress and egress. This agreement provides for conveyance of a private easement only and the easement will not grant any rights of travel over the grantor's lands to any governmental agency or to the general public in any manner whatsoever. The easement may not be used for access to any lands other than the hind described in paragraph 3. (2) Conditions of Easement. The conditions of this easement are: (a) The access proyided by this easement is a private right-of-way for the use of Grantees and Grantor only and is not for the use of the general public. (b) It is a common easement for the benefit of the Grantor's lands and the Grantees' lands described in paragraph 3. (c) Any construction by Grantees must be approved by Grantor prior to beginning construction. (3) Property Benefited by Easement. (5) Consideration. The consideration set forth aboye constitutes full and final Payment for the easement and right of way granted. (6) Binding Effect. The terms and conditions of this easement shall be binding upon and inure to the benefit of the heirs, successors in interest and assigns of the parties named in this instrument. The Grantor hereby waives and releases all rights to the described easement under and by virtue of the homestead exemption laws of the State of Wyoming to the extent that such rights may interfere with the purpose of this easement.
