For ten dollars ($10.00), and other valuable consideration, cash in hand paid, The
Pittsburg & Midway Coal Mining Co., a Missouri corporation, 116 Inverness Drive East, Suite
207, Englewood, CO 80112, ("Grantor"), hereby conveys to Thomas S. Wagner and Patricia
Wagner, husband and wife, as joint tenants, having an address of P.O. Box 336, Kemmerer, WY
83101 ("Grantees"), the surface only of the following described real estate, together with all
improvements located thereon, lying in the County of Lincoln, State of Wyoming,:
FN-13, as shown on survey map 261-A on record with the Lincoln County Clerk as Receiving
No.916795 and more particularly described as fÒllows:

A parcel of land being part of Tract 73 and 74 of the resurvey ofT 21N, Rl16W, of the 6th P.M. Lincoln County
Wyoming. Said parcel being bound on the north side by the centerline of Lincoln County Road 12-319 (Aspen
Springs Road) and on its west side by the east right of way boundary of U.S. Highway 189. Said parcel being more
particularly described as follows:
Commencing at comer No.1 of Tract 73 of the resurvey ofT 21N, R 116W of the 6th P.M., Lincoln County
Wyoming where is found a standard U.S. G.L.O. brass
cap. Thence SO° 03' 46"E, 2340.97 feet along the easterly boundary of said
Tract 73 a point on the centerline of Lincoln County Road 12-319 hereinafter
referred to as the "Aspen Springs Road". Said point being the Point of Beginning of this description.

aluminum cap on 5/8" rebar stamped "CCI, PELS 5465, FN-13, 2005." From which comer No.2 of said
Tract 73 bears S 0° 03' 36" E, 1325.88 feet;
Thence N 90° 00' 00" W, 1324.26 feet to corner No.2 of Tract 74 of said
T 21N, R 116W where is found a 1998 Uinta Engineering and Surveying 3"diameter aluminum cap on %"
diameter rebar stamped appropriately:
Thence S 89° 56' 36" W, 457.56 feet along the southwest boundary of said
Tract 74 to the intersection of a curve to the right on the east right of way boundary of U.S. Highway 189.
Said point being monumented with a 6" x 6" concrete post with brass cap hereafter referred to as a standard

other appropriate markings.
The following eight (8) courses being along the easterly right of way boundary of U.S. Highway 189.
Thence 154.04 feet along the arc of said curve to the right to the PT of said curve where is found a standard
highway R.O.W. marker. Said curve to the right having a central angleof3°38'27", a radius of2424.51
feet and a chord of 154.04 feet which bears N 37° 49' 41"E. Said standard highway R.O.W. monument
being stamped "PT-31+532.967, 61.000RT" with other appropriate markings;
Thence N 39° 44'07"E, 42.75 feet to apoint where is found a standard highway
R.O.W. marker stamped "31+546.000, JOG, 61.000 RT" with other appropriate
markings;
Thence N 50° 21' 49"W, 80.44 feet to a point where is found a standard highway
R.O. W. marker stamped "31 +546.000, JOG, 36.500 RT" with other appropriate
markings;
Thence N 39° 38' 18"E, 259.51 feet to the point of tangent to spiral ofa
spiral curve to the left. Said point being monumented by a standard highway
right of way marker stamped "TS-31 +625.094,36.500 RT" with other appropriate
markings;
Thence 338.00 feet along the spiral arc of said curve to the left to the
point of spiral to curve. Said spiral portion of said curve having a central angle
of 4° 46'26" and a chord of 337.90 feet which bears N 38° 02' 38"E.
Said point being monumented by a standard highway R.O.W. marker stamped
"SC-31 +725.094. 36.500 RT" with other appropriate markings;
Thence continuing 36.60 feet along the arc of the central curve to said
spiral curve to the left to the intersection of the west boundary line of said
Tract 73 and said east right of way of boundary of U.S. Highway 189. Said
intersection point being monumented by a standard highway R.O.W. marker
stamped "R.O.W. POC/TL, 31+735.608, 36.500 RT" with other appropriate
markings. Said central curve having a radius of2088.23 feet, a central angle of 1 ° 00' 16"and a chord of
36.60 feet which bears N 34° 14' 30"E .
Thence continuing 693.21 feet along the arc of said central curve to said
spiral curve to the left to the intersection of the center line of said Aspen Springs Road and said east right of
way of boundary of U.S. Highway 189. Said centra] curve having a radius of2088.23 feet, a centra]ang]e
of ]9° 01' 12"and a chord of690.03 feet which bears N 24° 21' ]3"E.
Thence S 88° 26' 45"E along the centerline of Aspen Springs Road 139.93 feet to the PC ofa curve to the
left;
Thence 203.35 feet along the arc of said curve to the left to the PT of said curve. Said curve to the left
having a centra] angle of] 9° 51 '26" and a radius of 586.74feet;
Thence N 71 ° 41' 49"E along the centerline of Aspen Springs Road 2] 6.80 feet to the PC of a curve to the
left;
Thence 45.69 feet along the arc of said curve to the left to the PT of said curve. Said curve to the left
having a central angle of2° 52'20" and a radius of911.52feet;
Thence N 68° 49' 29"E along the centerline of Aspen Springs Road 485.] 7 feet to the point of beginning.
Said parcel contains 44.614 acres more or less.
