For ten dollars ($10.00), and other valuable consideration, cash in hand paid, The Pittsburg &
Midway Coal Mining Co., a Missouri corporation and Chevron U.S.A. Inc., a Pennsylvania
corporation, both having offices at 116 Inverness Drive East, Suite 207, Englewood, CO 80112
("Grantors"), convey and quitclaim unto Fox Development, LP, a Texas Limited Partnership,
having an address of HC 64, Kemmerer, WY 83l 0 1 ("Grantee"), all minerals in the following
described real estate, lying in the County of Lincoln, State of Wyoming,:
FN-7, as shown on survey map 26l-A on record with the Lincoln County Clerk as Receiving
No.916795 and more particularly described as follows:
A parcel ofland being part of Tract 76 and part of Lots 6, 13 and 16 of Section 2 ofthe resurvey ofT 21 N, R 116W
of the 6th P.M., Lincoln County, Wyoming and being more particularly described as follows:
Commencing at the northwest corner of Section 2 of the resurvey of T 21 N, R 116 W, where is found a standard
D.S.G.L.O. brass cap;
Thence N 89° 27' 42" E along the north township line of said T 21 N, R 116 Wa distance of 260.70 feet to

Thence S 54° 49' 46" E along said south right of way boundary of Highway 233,
124.56 feet to the intersection of the west boundary line of Lot 7 of said Section 2
where is found a 2" aluminum cap on 5/8" rebar stamped, "CCI, PELS 5465,
HWY ROW, L T, 2005."
Thence continuing S 54° 49' 46" E, 1340.00 feet along the south
right of way boundary of said Highway 233, to a point where is found a 2" aluminum cap on 5/8" rebar
stamped, "CCI, PELS 5465, FN 51FN 6, ROW, 2005."
Thence S 54° 49' 46"E, 764.55 feet along said southerly right of way

Thence continuing S 54° 49' 46" E, 620.00 feet along said southerly
right of way boundary of said Highway 233 to the PT of a curve to the left. Said point being monumented
by a 2" aluminum cap on 5/8" diameter rebar stamped
"CCI, PELS 5465, HWY, ROW, PT LT, 2005."
Thence continuing along said southerly right of way boundary of
Highway 233, 113.75 feet along the arc of said curve to the
left to a point on the curve. Said curve to the left having a
central angle of 1 ° 38' 42", a radius of 3961.80 feet and a chord
of 113.75 feet which bears S 55° 39' 07" E. Said point on the
curve being monumented with a 2" aluminum cap on 5/8"
rebar stamped "CCI, PELS 5465, FN 7/ FN 8, ROW, 2005."
Thence S 11 ° 02' 14" W, 1959.72 feet to a point on the north
right of way boundary of Lincoln County Road 12-234 herein
after referred to as the Kemmerer Airport Road. Said point
being monumented by a 2" aluminum cap on 5/8" rebar stamped
"CCI, PELS 5465, FN-7/FN-8, ROW, 2005."
Thence N 61 ° 41' 00" W along said northerly right of way boundary
of the Kemmerer Airport Road, 75.00 feet to the PC of a spiral curve
to the left. Said point being monumented by a 2" aluminum cap on 5/8"
diameter rebar stamped "CCI, PELS 5465, PC, LC 234, ROW, 2005."
Thence along the arc of said spiral curve to the left through a central angle of
14° 24' a distance of265.13 feet to the point of spiral to curve (SC). The chord of said spiral curve bearing
N 66° 48' 13" Wand being 259.58 feet in length.
Said SC being monumented by a 2" aluminum cap on 5/8" diameter
rebar stamped "CCI, PELS 5465, SC, LC 234, ROW, 2005."
Thence 159.24 feet along a curve to the left, the radius of which
is 577.46 feet and having a central angle of 15° 48' 00" to the point of
the curve to a spiral (CS). The chord of said curve to the left being 158.74 feet which bears N83° 59'
OO"W. Said CS being monumented by a 2" aluminum cap on 5/8" rebar diameter stamped "CCI, PELS
5465, CS, LC 234, ROW, 2005."
Thence along the arc said spiral curve to the left. through a central angle of
9° 37' 40" a distance of 177.27 feet to a point on the spiral and the intersection of
the N-S centerline of said Section 2. The chord of said spiral curve
bears S 80° 55' 44" Wand being 177.06 feet in length. Said point on
the curve being monumented by a 2" aluminum cap on 5/8 diameter rebar stamped "CCI, PELS 5465,
POC, LC 234, ROW, 2005."
Thence N 0° 01' 14" E, 859.81 feet to the C Y. of said Section 2 being
monumented by a Uinta Engineering & Land Surveying, Cloey C. Wall,
3" aluminum cap on 2 W' aluminum pipe stamped appropriately and dated
1992:
Thence N 16° 51' 06" E, 1419.37' to the point of beginning.
Said parcel contains 35.221 acres more or less.
