GREEN,' hereinafter referred to as "Trustor", entered into a Di:~,claration of Trust, creating a revocable living trust ("Trust"). OTTO G. GREEN is the Trustor, the initial Trustee and the initial beneficiary of the Trust. The purpose of this instrument is to amend and restate the Trust in its entirety, as follows: 1. NAME OF TR',;rSr. The name of this Trust shall be the "Otto G. Green Living Trust, dated S:;ptember 3, 1993" 2. SUCCESSOR TRUSTEE. Unless some other person or entity is designated as Successor Trastee pursuant to the provisions of this Trust, the Successor Trustee shall be CRAIG E. MALMGREN, unless he is unable or unwilling to act as Successor Trustee, in which event BANK OF AMERICA is designated as Successor Trustee. 3. TRUST ESTAfE: The Trust Estate of the Trust consists of the property already' transferrec.'to the Trust, and which may be contributed in the future in accordance with tb..~::', terms of this instrument. 4. STANDARD IlIUST PROVISIONS: Schedule A hereto, which is hereby incorporated herein .i:)y reference, contains the provisions governing the terms of this Trust. 5. DISTRIBUTIC?N OF THE TRUST ESTATE. Upon the death of the Trustor, the Trust Estate sh:dl be held, administered and distributed as follows: A. T'h~ Trust.:.;e shall pay the expenses of the Trustor's last illness and funeral from either income or principal of the Trust Estate unless other adequate provision shall have been made therefore. B. The Trustee shall distribute all of the Trustor's tangible personal property, including but not liraited to, furniture, furnishings, automobiles, clothing, jewelry and other household effects to such person or persons as the Trustor shall have directed in a written m~morandum signed and dated by the'Trustor. C. The balar?.:e of the Trust Estate shall be held, administered and distributed as follows: I. On~ hundred (100) shares of Lucent Technology shall be distributed to each of the fo~.~lowing' (a) Trustor's friend, GAYLE REMBERT; (b) Trustor's friend, SALLY DeHAVEN, R.N.; (c). Trustor's friend, BELLE SPRING; and (d) Trustor's niece-in-laW, LOIS WALL. II. Two hundred (200) shares of Idaho power Company shall be distributed to LOIS WALL. III. Th¢:i sum of one million dollars ($1,000,000) shall be distributed to BOY SCOUTS OF AMERICA in Oakland, California. IV. Thi:.: sum of five hundred thousand dollars ($500,000) shall be distributed ..to SEEING EYE .DOGS in San Rafae!, California. V,~ The sum of two hundred fifty thousand dollars ($250,000) shall be distributed~;t° each of the following: (a): LOIS WALL; (b) i. The iresidue of the Trust Estate, after payment of all expenses and taxes, shall be distributed tO RUNNING STRONG FOR AMERICAN INDIAN YOUTH, a, projecii of Christian Relief Services, currently located at 24 Pecos Street, Raton,, NeWMexico 87740-9970. Said distribution shall be held 'as an endowment, with principal to remain intact.
