Martin, a single person, of 196 East 6th Street, Sioux Falls, SD 57104, grantor, for valuable consideration the receipt of which is acknowledged, grants and conveys to Gaylon G. Heiner and Kristi G. Heiner, husband and wife, of 3549 Lincoln County Road No. 123, Bedford, WY 83112, and their assigns who shall be among those persons owning the lands to be benefited by this easement as more particularly described in Paragraph 3 below, grantees, the following described perpetual right-of-way easement for the following purposes and under the following conditions: 1. Purpose of Easement. This easement is for the purpose of providing a 60-foot wide, nonexclusive, perpetual right-of-way easement for an aircraft take-off and landing runway on the existing Heiner Airstrip (lithe Airstrip") at its present location, including the right to inspect, construct, operate, maintain, and repair an aircraft runway and use that runway for purposes of take-off and landing of aircraft. 2. Conditions of Easement. The conditions of this easement are: a. The easement may only be used by aircraft for landing and take-off and related taxi purposes and by other aircraft-related or airport-related vehicular traffic. If the airstrip ever ceases to be used as an aircraft runway, then this easément shall immediately terminate and be considered null and void. Cessation of use of the aircraft airstrip runway shall be defined as a calendar year in which fewer than 10 aircraft landings or take-offs occur on the airstrip. b. Anyone using the Airstrip for· the landing or take-off of aircraft assumes all risk of doing so and hereby· agrees to indemnify and hold grantor harmless from any and all liability resulting from such use. They also assume all risk for the construction, operation, maintenance, and repair of the Airstrip and agree to indemnify and hold grantor harmless from any and all liability resulting from any such activities conducted on the easement. c. Anyone using the Airstrip must do so according to all FAA rules and regulations and any and all other laws governing the use of the easement for landing or take-off of aircraft. This easement is for the benefit of the following described real property of the grantees in Lincoln County, Wyoming: SE1/4SE1/4 of Section 3, SW1/4SW1/4 of Section 2, NW1/4NW1/4 of Section 11, NE1/4NE1/4 of Section 10, SW1/4NE1/4 of Section 10, N1/2SW1/4NW1/4 of Section 11, N1/2SE1/4NE1/4 of Section 10 of T33N, R118W of the 6th P.M., Lincoln County, Wyoming. 4. Description of Easement. The easement is described as follows: A strip of land sixty (60) feet in width, within the N1/2NW1/4NW1/4 of Section 11 T33N, R118W, Lincoln County, Wyoming, thirty (30) feet each side of the centerline more particularly described on the attached "Description for Gaylon and Kristi Heiner Airstrip Easement". 5. Binding Effect. The terms and conditions of this easement shall be binding upon and inure to the benefit of the heirs, successors in interest and assigns of the parties named in this instrument. 6. Waiver of Homestead Rights. The grantor hereby waives and releases all rights to the described easement under and by virtue of the homestead exemption laws of the State of Wyoming to the extent that such rights may interfere with the purposes of this easement.
