AFFIDAVIT ESTABLISHING SUCCESSOR TRUSTEE STATE OF UTAH ss. County of Cache L. BRENT HOGGAN, being first duly sworn on oath deposes and says: 1. He is a resident of the age of twenty-one (21) knowledge to state and swear North Logan, Cache County, Utah, over years and is competent by personal to the things hereinafter contained. 2. He is an attorney authorized to practice law in the State of Utah. 3. That he was the attorney for Archie C. Pyle during his lifetime. 4. Archie C. Pyle died in Logan, Utah on July 7, 2004. His death is evidenced by State of ,Utah Department of Health Certificate of Death, Local File No. 03-215, a certified copy of which is attached to and by reference made a part of this Affidavit. At the time of his death Archie C. Pyle was a resident of and domicile in Logan, Utah. 5. On April 18, 1991, Archie C. Pyle made and executed a Declaration of Trust, creating the Archie C. Pyle Revocable Trust ("Trust") declared himself as the Trustee thereof during his lifetime and designated Myrna Dell Samsel as successor trustee of the Trust upon his death. 6. Pursuant to the terms of the Declaration of Trust, Archie C. Pyle on April 18, 1991, made, executed and delivered to himself as trustee of the Trust a Mineral Deed to all of his coal, oil, gas and mineral rights (being a 1/200 interest) in that certain real property in Lincoln County, Wyoming described on Exhibit "A" attached hereto and by this reference made a part hereof. Said Mineral Deed was recorded April 7, 2000, in Book 443 at Page 764 / 0920639 000007 2 and 765 as entry number 865215 in the records of the Lincoln County¡ Wyoming Recorder. 7. Myrna Dell Samsel survived Archie C. Pyle and on July 25 I 2006¡ Myrna Dell Samsel signed an Acceptance of Trusteeship of the Trust. A copy of said Acceptance is attached to this Affidavit and by this reference made apart hereof. 8. By reason of the death of Archie C. Pyle¡ the terms of the Trust and the Acceptance of Trusteeship signed by Myrna Dell Samsel¡ Myrna Dell Samsel has become and now is the trustee of the Trust and the owner as trustee of the Trust of the mineral rights described in paragraph 6 of this Affidavit in the real property described on Exhibit "A" hereto. U 1 ACCEPTANCE OF TRUSTEESHIP KNOW ALL MEN BY THESE PRESENTS: That I, MYRNA DELL SAMSEL, hereby accept the Trusteeship of the ARCHIE C. PYLE REVOCABLE TRUST dated April 18, 1991, and hereby agree to act as Trustee of said Trust on all the terms, provisions and conditions specified in said Trust.
