DISI'RIB1TI10N EASEMENT
KNOW ALL MEN BY THESE PRESENT:
That the undersigned, ANNA C. HODSON, 11& Sole Owner, ("Gnmtor") for a good and valuahle
consideration, the receipt of which is hereby acknowledged, do hereby grant, convey and warrant ur.,to
Lower Valley Energy, 8 Cooperative Corporation. of Afton and Jaokson, Wyonùng and to its. successors 8:Jd
assigns, ("Grantees"), a perpetua1 easement and right of way for the construction and continu:d
maintenance, repair, alteration and replacement of the electric distribution circuits, lines and equipment of
the Grantee to be constructed and maintained under, upon and across the premises of Gnmtor in Lincoln
County, State of Wyoming, along a line descnDed. as fonows, to wit:
BEING a portion of Jot 35, SVR Plat 22 within Section 30, T35N, Rl18W, in Lincoln County, Wyombg
more particularly described as follows,
COMMENCING at a point 38 feet west of the NE corner of said lot 35. Thence S SOB, 30 feet; thence S
15°E, 138 feet to a transformer location. Easement to include 10 feet on each side of descn'bed line, excc pt
to IlJUTOW as necessary to accommodate east property line.
EASEMENT to include 10 feet on each side of described line, together with all necessary and reasonahle
rights of ingress and egress and to excavate and refill ditches and trenches for the location and repair of Mid
facilities and to cut, trim, spray herbicides, or remove trees, shrubbeIy, undergrowth or other obstructions
interfering with the repair and maint""Anr.e of the 1àcilities.
The Grantor acknowledges that E]ectric and Magnetic Fields (EMF) arc naturally occwring in the
transmission or distribution of electricity, and tha.t the Gnmtee has here notified Gnmtor that EMF testhg
and infonnation is available upon request £Tom the Grantee. This Easement by Grantor is intmded to
include so much spac~ as is necessary or appropriate to the presence of EMF and reasonab]e operation of
the Grantee's distribution lines,
Grantor agrees that all po]es, wires and other facilities, installed on or under the described lands &11:111
remain the property of the Grantee removable in the sole discretion of the Grantee at the Grantee's expen!;e,
The rights. conditions and provisions of this easement shall inure to the benefit of and be binding upon the
parties, their heirs, executors, administratora, successors and assigns. Grantor shall compensate Grantee jor
any damages to Grantee's facilities caused by Grantor, including payment of Grantee's attorney fees if
action is \Dldertakcn by Grantee to enforce the commitments descn'bed in this easement. Grantor reserves
the right to improve, occupy and use this easement for all purposes not inconsistent with the easement gra:lt
Each party shall have the remedy of specific perfonnance regarding this easement The rights a:Jd
obligations described in this easement shall run with the land. This easement is not exclusive, and Gran10r
retains all rights not specifically granted by this easement This is the entire agreement of the parties
regarding this easement, except as may be set forth in writing after the date of this easement and signed 'JY
