UTILITY DEVELOPMENT AND EASEMENT RESTRICTION COVENANT
This Agreement, made this ~ day of June, 2006, by Russell Motzkus and
Michelle Motzkus husband and wife, Bedford, WY 83112 (Motzkus), and RobeFf L.
Sanderson and Sharon Sanderson, husband and wife, of Etna, WY 8~ 127 (Sanderson).
WHEREAS, the parties each own a portion of the real property burdened and
benefited by the Easement described in EXHIBIT A, attached to this Agreement, and;
WHEREAS, it is the desire and intention of the Parties to this Agreement that in the
event one of the parties installs utility improvements within the easement described in
EXHIBIT A, that the land benefited by the improvement installed be responsible for the
proportional share of the costs of said utilities. The degree to which the parcel is liable for
the share of the costs shall be described below, and;
WHEREAS, it is the desire and intention of the Parties to this Agreement that a
certain degree of control of access to the easement described in EXHIBIT A be given to the
Parties,
NOW, THEREFORE, in consideration of the covenants and promises contained
herein, the Parties hereby agree that all of the property described in EXHIBIT B, attached
hereto, shall be benefited and burdened by the following covenants and restrictions. Said
covenants and restrictiQns shall run with the land and be binding upon any subsequent
suc,cessor or assign in title from the Parties to this Agreement.
REIMBURSEMENT FOR UTILITIES
1. The Parties hereby agree and covenant that if within ten (10) years from the
commencement of installation of utilities and road improvements, and in the event any
subsequent successor in title connects to the utilities and road improvements, the Party, or its
successor in title, responsible for the installation of the utilities and road improvements, shall
have the right to a proportional reimbursement from the owner of the parcel of property
bordering the improvement. Said reimbursement right shall only be enforceable in the event
the successor in title connects to the installed utilities. Said reimbursement shall be for an

amount equal to the bordering landowner's linear footage as it pertains to the improvements

2. The Parties hereby reserves for themselves, and their successors and
assigns, the right to restrict any connection to the utilities and road improvements
installed by the Parties, and to restrict access to the easement by any subsequent . .
successor in title, along the Easement described in EXHIBIT A, until the non improving
party, or their successors or assigns, have reimbursed improving party for the costs of the
installation of the above described utilities and road improvements according to the.
proportionate share of the costs of the road improvements within the Easement described
in EXHIBIT A.
MAINTENANCE OF EASEMENT/COVENANT NOT TO BLOCK EASEMENT
1. The Parties, their successors or assigns, hereby reserve the right to access
the above described Easement for the purposes of maintaining the above named utilities
and road improvements, and;
2. The Parties hereby covenant that no structures, plantings, materials, or
obstacles shall be permitted to remain within the above described easement, or permit any
activity or obstruction which may cause damage to the installed utilities and road
improvements or allow activities which may interfere with the rights reserved in this
Covenant.

GRANT OF EASEMENT
ROBERT L. SANDERSON and SHARON SAN~ERSON, husband ànd wife., Grantors,
of County of Lincoln, State of Wyoming, för and in consideration of TEN DOLLARS ($10.00)
and other valuable consideration, in hand paid, receipt of which is hereby acknowledged,
CONVEYS AND WARRANTS to, RUSSELL MOTZKUS and MICHELLE MOTZKUS

ors, and assigns, an easement over, across and through the following described property:
I. Purpose of Easement. This easement shall be for underground utilities and
ingress and egress to Grantee's property within the NE 1/4 SE 1/4 of Section 10, T35N, R119W,
Lincoln County Wyoming, said dominantestate being more particularly described in Book 572
page 184.
2. Description of Easement. The easement shall occupy and be over, across and

377 PR628, located in the Recorder's Office of the Lincoln County Clerk, the entire easement
being more particularly descri~ed as follows: .
BEGINNING at the northeast corner of said tract, marked by a spike on the east line of said
'NEI/4SEI/4 SOO° -07.9'E, 206.83 feet from the northeast corner of said NEI/4SEI/4;
Thence continuing SOO° -07.9'E, 198.56 feet, along said east line, to the southeast corner of said
tract, marked by a spike;
Thence S89° - 44.0'W, 672.52 feet, along the south lïne of said tract, to a point under an existing
north/south fenced;
Thence NO 1 0 -08.4'W, 198.20 feet, along said fence, to a point on the north line of said tract;
Thence N89° - 42.0'E, 676.01 feet along said north line, to the CORNER OF BEGINNING;

Lincoln County, Wyoming, for ingress, egress, and utilities being twenty (20) feet to the north
