HomeMy WebLinkAbout921080 GOQ5t9 GRANT OF EASEMENT MARVIN LEE SCHWAB, Grantor, of County of Lincoln, State of Wyoming, for and in consideration of TEN DOLLARS ($10.00) and other valuable consideration, in hand paid, receipt of which is hereby acknowledged, CONVEYS AND WARRANTS to, THE TOWN OF AFfON, a Wyoming Municipal Corporation, Grantees, of County of Lincoln, State of Wyoming, and their heirs, success ors, and assigns, an easement over, across and through the following described property: 1. Purpose of Easement. This easement shall be for the Town of Afton's ingress/egress, for the placement and maintenance of utilities, maintenance of the roadway and provision of emergency services. 2. Description of Easement. The easement shall occupy and be over, across and through the following described serviant property: That part of Rocky Road Circle as depicted on Twin Cliff Subdivision Amended of record in the Office of the Clerk of Lincoln County as Plat No. 337-A EXCEPTING for the sixty (60) foot cul-de-sac; AND A strip of land sixty (60) foot in width within Lot 3 and Lot 4 of said Twin Cliff Súbdivision Amended in the SEl/4SW1I4 of Section 18, T32N R118W, Lincoln County, Wyoming, with the centerline described as follows: BEGINNING at the southeast corner of said Lot 3; thence NOoo-04' -03"W, 741.81 feet, along the east line of said Lot 3, to a spike; AND A sixty (60) foot radius cul-de-sac with the center of said cul-de-sac being NOoo-04' -03"W, 7 41. 81 feet, from the southeast corner of said Lot 3; the BASE BEARING for this survey is the west line of said Lot 3, identical with the west line of the SE1I4SW1I4 of Section 18, T32N R118W, being SOoo -06' -47"E; the easterly and westerly right-of-way lines of the above described easement to be shortened or lengthened as necessary to create a continuous easement with a minimum width of sixty (60) feet to meet the northerly right-of-way line of Twin Cliffs Road as depicted on said Twin Cliffs Subdivision; each "spike" marked by a 3/8" x 12" steel spike referenced by a 5/8" x 24" steel reinforcing rod with 2" aluminum cap inscribed, "SURVEYOR SCHERBEL LTD AFfON WY PLS 5368", with appropriate details; all in accordance with the plat prepared to be filed in the Office of the Clerk of Lincoln County titled, "FINAL PLAT TWIN CLIFFS 4TH ADDITION TO THE TOWN OF AFrON IDENTICAL WITH LOT 3 OF TWIN CLIFFS SUBDIVISION WITHIN THE INCORPORATED LIMITS OF THE TOWN OF AFfON IN THE SEl/4SWl/4 SECTION 18 T32N R118W LINCOLN COUNTY, WYOMING", dated 20 April 2006, as revised. 3. Binding Effect. The terms and conditions of this easement shall be binding upon and inure to the benefit of the heirs, successors and assigns of the parties named in this instrument.
