Exclusive Assignment of Road Easement
Whereas David Whitney Minerals, Inc. , Grantor, and its predecessor
in title U. S. Phosphate Company constructed a road from Raymond,
Idaho into the Raymond Canyon, Wyoming about 1915 in order to" ship
phosphate rock to its warehouse in Border, Wyoming for shipment to
California via the Oregon Shortline Railroad; and Whereas Grantor has
agreed to convey the surface of M. S. 465 to Grantees Kreager
Investments, LLC and Equity Trust Company Custodian FBO John. T.
Kreager IRA, but is retaining the mineral rights and hereby retains a road
access into M. S. 465, for access to its mineral rights by it, its leasees,
successors and assigns, agents, representatives and contractors; and
Whereas this assignment is an access easement for ingress and egress to
the land, runs with the land, and benefits the heirs, devisees and grantees
of the Grantor and the Grantees and is described in the attached Exhibit A;
Now Therefore the Grantor does hereby convey an exclusive
Assignment of the road described in the attched Exhibit A to Grantees for
Grantees' access in and to the surface of M. S. 465, namely the Bledsoe,
Hargis and Harpeth Lodes and will grant no further access to other
surface owners without the consent of the Grantee. Grantor further agrees
to park no vehicle to block Grantees' access to their SUrftfJrights. '".

Easement lA: a strip of land sixty (60) feet in width lying 30 feet on both sides of
the following described line:
Beginning dt a point in the easterly right of way of a state highway that lies
North 89 degrees 52 minutes 31 seconds West 2730.56 feet and South 1319.79
feet from the Northwest corner of Section 6, Township' 26 North, Range 119
West of the Sixth Principal Meridian and running thence North 89 degrees 21
minutes 47 seconds East 1264.74 feet; thence North 89 degrees 40 minutes 33
seconds East 1330.32 feet to the beginning of a curve tangent to said line; thence
along said curve, to the left a distance of 136.43 feet, said curve having a radius
of 230.00 feet, a central angle of 33 degrees 59 minutes 14 seconds and a chord
that bears North 72 degrees 40 minutes 56 seconds East 134.44 feet; thence North
55 degrees 41 minutes 19 seconds East 77.26 feet; thence North 57 degrees 34
minutes 54 seconds East 1339.47 feet to the beginning oT a curve tangent to said
line; thence along said curve to the right a distance of 68.31 feet, said curve
having a radius of 100.00 feet, a central angle of 39 degrees 08 minutes 25
seconds and a chord that bears North 77 degrees 09 minutes 07 seconds East
66.99 feet; thence South 83 degrees 16 minutes 41 seconds East 429.07 feet;
thence South 87 degrees 19 minutes 20 seconds East following the existing road
935.72 feet to the west line of the Bledsoe Claim in Raymond Canyon
