Eastland Drive, Twin Falls, Idahb, for and in consideration of Ten Dollars ($10.00)and
other good and valuable consideration, in hand paid, receipt whereof is hereby
aCknowledged, CONVEYS AND QUITCLAIMS to Kenneth D. Nebeker and Meteese C.
Nebeker, husband and wife, as'tenants by the entireties, Grantees, whose address is PO
Box 66, Smoot, Wyoming 831~6 the following described.real estate, situated in Lincoln
County, State of Wyoming, 'heronry releasing and waiving all rights under and by vidue of
the homestead exemption laws of the State, to-wit:
Parcel l-NW1/4NW1/4 D~:~t 1, Section 7, Township 30 N., Range 118 W., 6~'
P:M. Wyoming.
Parcel 2-SW.1/4SW1/4~(~:~ot 7) Section 6, Township 30 M., Range 118 W.,
6t" P.M. Wyoming.
In addition, Carol Gerb~r-AIIred does hereby release any and all claims to
the following described ~rovisions contained in that ce~ain Warranty Deed
from Kenneth D. Nebeker and Meleese C. Nebeker, Grantors, to Carol
Gerber-Allred, Grantee, Which was dated November 11, 1992, and recorded'
on May 21, 1993, in book 329PR at page 145 in the records of the Lincoln
CountY Clerk, which proVisions relate to the above described propeAy and
are as follows:
1. THE SELLER alSO grants within the Sellers' rights and ability to do so,
the right for the Purchaser to have. access (a hookup) on the buried Nebeker
culina~ water pipeline as it passes through Parcel 1. The Purchaser will pay
a pro rata share of the :Cost of the maintenance of the water system upon
completion of hookup.. Purchaser will also paY a pro rata share of the
installation of a larger ho~ding tank on said pipeline when installation occurs.
The purchaser also Understands the value of culina~ hookup to be
approximately $3,500.00.
2. FURTHER, the S'elle~ agrees that neither the Seller nor their heirs or
assigns will build a hom~; or other structure of any kind on the lands retained
by the Sellers in Parcel: ! without the written consent of the Purchaser.
3. FURTHER, the ~'~ller grants to the Purchaser a road right-of-way for
egress and ingress, tb~t,.Ay (30) feet in width over the presently existing
roadway, generall~ described as running from the County road near the
noAhwest corner of P~:rcel 1' in a southeasterly direction to the propeAy
purchased by the Purchaser in Parcel 1. FuAher, the Purchaser or Seller
may at their own expe,~nse, have said roadway su~eyed and have said
roadway filed of record.
~ 4. FURTHER, all water rights appeAaining to the Prope~y being sold go
to the Purchaser and paAicularly those under the Westside Irrigation System.
All 1992 assessments to the water system will be paid by Sellers.
5. FURTHER, in the event'that at some future date Sellers wish to sell,
transfer, or convey, an~ paK of the lands being retained by Sellers pursuant
to the Warranty Deed exceptions, Sellers grant a first option to Buyer to
purchase the lands at "fair market value" and will notify Purchaser of such
intent.
6. THE SELLER, ais.:~ grants within the Sellers' rights and ability to do
so the right for (he Pui, crhaser to have access (a hookup) on the buried
Nebeker culinary water pipeline as it exists, and is in place on Parcel 3. The
purchaser will pay a pro rata share of the cost of the maintenance of the
water system upon compL.t~on of hookup.. Purchaser will also pay a pro rata
share of the installation of a larger holding tank on said pipeline when
installation, occurs. The P[irchaser also understands the value of the culinary
hookup to be approximately $3,500.00.
It being the intent of this quitclaim deed and release agreement that Grantor
relinquishes any and all rights to the above entitled property and releases
any claims to the provisi°ns'as contained in the above described Warranty
Deed. ~,
TOGETHER WITH all ir'?lProvements, appurtenances, hereditaments and all
other things thereunto belonging or in anywise appertaining.
