MODIFICATION TO MORTGAGE
MODIFICATION TO MORTGAGE, made this /t/fß day of September, 2006, by
and between JOYCE KAY JACOBS and RONNIE F. JULIAN, Trustees of the CREDIT
SHELTER TRUST created undertheHARRYF. JULIAN TRUST, dated July 19, 1991, as
Trustees of the QTIP TRUST created under the HARRY F. JULIAN TRUST, dated July 19,
1991, and as Trustees of the TEENY MAY JULIAN TRUST, dated July 19, 1991,
hereinafter referred to as "Mortgagee", and FOX LAND & LIVESTOCK CORP., a
Wyoming corporation, hereinafter referred to as "Successor Mortgagor".
WHEREAS, by a Mortgage dated January 22, 2003, and recorded in the Office of the
County Clerk of Lincoln County, Wyoming on January 23,2003, in Book 510, Page 376-377
(the "Mortgage"), Robert B. Fox and Jayson B. Fox mortgaged to the Mortgagee certain real
property and improvements as described in the Mortgage; and
WHEREAS, by Quitclaim Deed dated March 5, 2003, and recorded in the office of
the County Clerk of Lincoln County, Wyoming on March _,2003, in Book 514 PR, Page
795, Robert B. Fox and Jayson B. Fox conveyed, subject to the Mortgage, all of their interest
in the real property covered by the Mortgage to the Successor Mortgagor; and
WHEREAS, the Successor Mortgagor desires to remove certain of the improvements
from the mortgaged premises and the lien of the Mortgage and the Mortgagee is willing to
pennit the Successor Mortgagor to remove such improvements under the tenns and
conditions hereinafter provided; and
WHEREAS, the parties desire to modify the Mortgage accordingly.
NOW, TIIEREFORE, IT IS MUTUALL Y UNDERSTOOD AND AGREED THAT:
1. REMOVAL OF DWELLING. Successor Mortgagor shall have the right to
remove from the mortgaged premises, free of the lien of the Mortgage, the dwelling unit
currently installed on a foundation at the ranch headquarters area of the mortgaged premises,
and the Mortgage is hereby amended accordingly. As a condition of Mortgagee's consent to
such removal, Successor Mortgagor shall remove the dwelling without damage to the
concrete foundation, plumbing and utility connections related to the present dwelling location
and shall, for so long as the Mortgage shall remain in effect, preserve and protect the
condition and integrity of such concrete foundation, plumbing and all utility connections
related to the present dwelling location. Further, in the event of a default under the Mortgage
by the Successor Mortgagor, the Successor Mortgagor, at the Successor Mortgagor's sole

expense, shall be required to restore such dwelling to its original location and condition, fully
functional for living purposes, or likewise replace such dwelling with a dwelling oflike size,
kind, quality and value.
2. MORTGAGE OTHERWISE UNCHANGED. The intent of this Mbdification
of Mortgage is only to modify and amend those provisions of the Mortgage as herein
specified. Except as herein specifically modified and amended, all of the terms and
provisions of the Mortgage shall remain in full force and effect.
