AFFIDAVIT OF SURVIVORSHIP

COUNTY OF LINCOLN )
DENNIS W. LANCASTER and LESLIE D. LANCASTER, husband and wife, being
first duly sworn on oath deposes and states as follows:
1. That DENNIS W. LANCASTER AND LESLIE D. LANCASTER are of adult
age and reside in Lincoln County, Wyoming.
2. That DENNIS W. LANCASTER is the surviving son of DELMAR C.
LANCASTER, who died May 21,2006, in St. George, Washington County,
Utah, as hereinafter more fully appears.
3. That DENNis W. LANCASTER is the surviving son of SYBIL W.
LANCASTER, who died August 10, 2006, in Afton, Lincoln County,
Wyoming, as hereinafter more fully appears.
4. That by a Warrenty Deed dated March 5, 1982, and recorded July 6, 1993,
in the office of the County Clerk and Ex Officio Register of Deeds in and for
the County of Lincoln, State of Wyoming, in Book 331 PR, Page 493,
DELMAR C. LANCASTER and SYBIL W. LANCASTER as Grantors,
Conveyed to DENNIS W. LANCASTER and LESLIE D. LANCASTER ,
husband and wife, as Tenants by the entireties, of P.O. Box 1589, Afton,
Wyoming 83110, Lincoln County, State of Wyoming, the following described
real estate situated in Lincoln County, State of Wyoming, to-wit:
The S~ NWX; and W~ SEX; and N~ SWX; and SEX SWX of
Section 33, T30N, R118W of the 6th PM, Lincoln County Wyoming,
EXCEPTING THEREFROM a tract of land described as follows:

Beginning at a point 30 rods West of the NE corner of the SWX NWX of
said Section 33, and running 16 rods South, thence West 50 rods, thence
North 16 rods, thence East 50 rods to the point of beginning;
RESERVING UNTO GRANTORS Delmar C. Lancaster and Sybil W.
Lancaster, a life estate in an undivided one-half (~) interest of all minerals
and all mineral rights of every kind and character owned by Grantors, now
known to exist or hereafter discovered, including, without limiting the
generality of the foregoing, coal, oil and gas and rights thereto, together with
the sole, exclusive and perpetual right to explore for, remove and dispose of,
said minerals.
5. That DELMAR C. LANCASTER died on the 21st day of May, 2006, in St.
George, Washington County, State of Utah, and thereupon, the certificate of
his death was duly filed with the State of Utah and made a matter of record
in said office, and a certified copy of said certificate is attached hereto
marked Exhibit "A" and made a part of this affidavit.
6. That SYBIL W. LANCASTER died on the 10TH day of August, 2006, in
Afton, Lincoln County, State of Wyoming, and thereupon, the certificate of
her death was duly filed with the State of Wyoming and made a matter of
record in said office, and a certified copy of said certificate is attached hereto
marked as Exhibit "B" and made a part of this affidavit.

7. That upon the death of DELMAR C. LANCASTER and SYBIL W.
LANCASTER, as aforesaid, the reservation ofthe life estate in an undivided
one-half (%) interest of all minerals and all minerals rights of every kind and
character as owned by them was terminated, and DENNIS W. LANCASTER
and LESLIE D. LANCASTER, husband and wife, as Tenants by the
entireties, became vested with any and all interest in the undivided one-half
(%) interest of all minerals and all mineral rights of every kind and character
that was owned by said DELMAR C. LANCASTER and SYBIL W.
LANCASTER pertaining to the property described herein.
