I, WILLIAM P. BIRMINGHAM, being first duly sworn on oath, depose and say:
1. THAT I am a citizen of the United States of America over the age of 21 years, and a resident
of Wyoming.
2. THAT I am the surviving spouse of KRISTIN M. BIRMINGHAM. Kristin M Birmingham
died on March 12,2002 in Sweetwater County, Wyoming. A certified copy of her Certificate of Death
is attached hereto and incorporated herein.
3. THAT Kristin M Birmingham and myself were married on December 3, 1977, in
Binghampton, Broome County, New York.
4. THAT Kristin M Birmingham and myself, wife and husband, as joint tenants, own real
property situated in Lincoln County, Wyoming. This real property is described to wit:
Lot 8 of Henry's Mountain Estates, Lincoln County, Wyoming according to that
plat filed in the Office of Lincoln County Clerk on November 4, 1996, Instrument
No. 828555, Plat No. 371.

5. THAT thirty (30) days have elapsed since the death of Kristin M Birmingham.
6. THAT no Application of Appointment of a Personal Representative is pending or has been
granted in any jurisdiction.
7. THAT as the result of the death of Kristin M Birmingham, the estate or interest we held as
husband and wife, in the above-referenced property has terminated according to law, and I, as the
surviving spouse, am entitled to hold title individually to said property and exercise all rights and powers
over said property. No other distributees of the decedent have a right to succeed to the property under
any other proceedings.
8. THAT this Affidavit fully complies with W.S. 34-11-101, as amended.
