WHEREAS, Peavler, Kleeman, and Klingler own adjoining real estate located near
Afton, Lincoln County, Wyoming, described, respectively, as follows:
Property owned by Peavler: See attached EXHIBIT A;
Property owned by Kleeman: See attached EXHIBIT B; and
Property owned by Klingler: See attached EXHIBIT C; and

~REAS, Peavler, Kleeman, and Klingler have reached mutual agreement for a
nonexclusive right of way easement for ingress and egress for the non-exclusive benefit of the
properties owned by the parties.

NOW, THEREFORE, Peavler, Kleeman, and Klingler, for themselves, and their heirs,

A. EASEMENT. A nonexclusive right of way easement for ingress and egress on
that portion of the property owned by Peavler and Kleeman that is described in EXHffiIT D to,
and in favor of the property owned by Klingler, described in EXHIBIT C, is hereby created over

the above-described easement area ("Easement Area").
The Easement Area shall remain
available for, and Peavler and Kleeman hereby reserve the right to, ingress and egress across said
Easement Area.
B. CONSIDERATION. Peavler and Kleeman hereby acknowledge receipt ofTEN
DOLLARS ($10.00) and other valuable consideration, in hand paid, for the right of way
easement granted herein.
C. EASEMENT NOT TO BE OBSTRUCTED. Except for temporary obstructions
required for the purposes of maintaining and improving the Easement Area, the Easement Area
shall not be obstructed in any manner that would impede free ingress and egress.
D. MAINTENANCE AND IMPROVEMENTS. Peavler, Kleeman, and Klingler
hereby agree that as a part of the consideration for this right of way easement, Peavler and
Klingler shall be jointly responsible for maintaining the Easement Area, each to pay one-half of
the costs of such maintenance, and that Kleeman shall not be responsible for any such costs. The
parties agree that the Easement Area shall be maintained in reasonably good condition and
passable as a graveled roadway. Improvements to the Easement Area shall be at the expense of
the party making such improvements unless the other party or parties agree in writing to share
the costs of such improvements.
E. EASEMENT TO RUN WITH THE LAND. The right of way easement created
herein shall run with the lands identified herein, and shall be binding on and shall inure to the
benefit of the parties to this Easement Agreement, and their res,?ective heirs, successors or
asSIgns.

F. WAIVER OF HOMESTEAD RIGHTS. The parties hereby waive any and all
rights to the Easement Area under and by virtue of the homestead exemption laws of the State of

Wyoming.

Excepting therefrom all of that portion of this description
lying within Tract 7 of said "Peavler Family Exemption, 2nd
Filing.
The sidelines of said 50 feet wide strip of land to be
lengthened or shortened to terminate at the boundaries of said
Tract 6, Tract 7 and at the easement boundary of said existing 60
feet wide access and utility easement.
Said 50 feet wide strip of land contains 0.82 acres, more or
less, and is subject to any easements, rights-of-way,
reservations or restrictions of sight and/or of record.
As shown on Exhibit "0-1", attached hereto by this reference made
a part hereof.

A parcel of land located in Tract 7 of that Map of Survey
titled "Peavler Family Exemption, 2nd Filing", recorded in the
Office of the Lincoln County Clerk, said Tract 7 being located
in the SEI/4 NE1/4, Section 29, Township 32 North, Range 119
West, 6TH PM, Lincoln County, Wyoming, said parcel of land being
more particularly described as follows:
Beginning at a Point, being the northwest corner of Tract
7, of said "Peavler Family Exemption, 2nd Filing;
Thence along the northerly boundary line of said Tract ~,
N89"29'26"E, 69.64 feet;
Thence departing said northerly boundary line, S46"18'38"W,
14.79 feet;
Thence S52·35'59"W, 64.94 feet;
Thence S57D16'51"W, 8.18 feet to a point on the westerly
