Pursuant to W.S. § 1-6-108, Colters Lodge, Inc., by and through its attorney,
James K. Sanderson, hereby gives notice that there is currently a pending action, Civil
No. 2006-188-DC, which has been filed with in the District Court of Lincoln County
Wyoming, Third Judicial District in and for the State of Wyoming. The following
information is provided to all parties:
1. The Plaintiff in the above referenced action is Colters Lodge, Inc.,
2. The Defendants are Richard Kun..1cle, :t-.1aria Simental and, Justin Victor
Kallal. ----
3. The Complaint filed by the Plaintiff seeks to foreclose on the contract for
sale of certain property located in Afton, Lincoln County, Wyoming and the satisfaction
of any deficiency from the sale of the property by way of the sale of certain assets and
real property pledged by the Defendants under the terms of the contract. Said real
property is described as:

BEGINNING 66 feet West of the Southeast corner of Lot #3 of Block #17 in the
Town of Aft on, County of Lincoln, and the State of Wyoming, and running thence West
66 feet, thence North 165 feet, thence East 66 feet; thence South 165 feet to the point of
beginning. Together with all improvements and water rights.
ALSO: Beginning at the Northwest corner of Lot #3 of Block #17 in the Town of Afton,
Lincoln County, Wyoming, and running thence East 20 rods; thence South 10 rods;
thence West 8 rods, thence South 10 rods; thence West 11 feet; thence North 10 rods;
thence West 22 feet; thence South 141/3 feet; thence West 10 rods; thence North 179 1/3
feet to the place of beginning, together with all improvements and water rights.
ALSO: Beginning at the Southeast corner of Lot #3, Block #17, Afton Townsite, and
running thence West 66 feet; thence North 165 feet; thence East 66 feet; thence South
165 feet to the point of beginning. Together with all improvements and water rights.
EXCEPTING THEREFROM: Beginning at the Southeast corner of Lot#3, Block #17,
Afton Townsite,·and running thence West 66 feet; thence North 125 feet; thence East 66
feet; thenëe'SQuth 125 feet to the point of beginning. Subject to reservations and
restrictions contained in the United States Patent and to easements and rights-of-way of
record or IIi use: Töge'ther 'with all improvements and appurtenance thereon.

4. Type of Action. Plaintiffs have made claims for breach of contract and are
seeking to foreclose on the property.

can be found in the files of the District Court of Lincoln County Wyoming, Third Judicial
District, specifically the Complain.
6. Notice. All parties are hereby put on notice of this action.
