Home My WebLink About924051 000224 AFFIDAVIT Patricia J. Garrey, of lawful age being first duly sworn according to law, upon her oath, deposes and says: 1. That Donald E. Garrey died intestate at 723 Ridge Avenue, in Rock Springs, Wyoming 82901, on April 21, 2005. 2. That Patricia J. Garrey and Donald E. Garrey were married to each other in Pennington County, South Dakota on October 22,1955, and were husband and wife continuously from said date until the death of said Donald E. Garrey. 3. That on July 28, 1980, said Donald E. Garrey and Patricia J. Garrey, husband and wife, purchased the following-described real property from Battlefield, Inc., a Wyoming corporation: Unit J-59 Commissary Ranch Subdivision as said lots are laid down and described on the official plat of said Commissary Ranch Subdivision -'duly recorded in the office of the county clerk and ex-officio register of deeds of Lincoln County, Wyoming, together with all improvements thereon, and easements, appurtenances and incidents belonging or appertaining thereto, or used in connection therewith. Subject, however, to all mining, mineral and other exceptions, reservations, covenants, conditions and rights-of-way of record. 4. That said Battlefield, Inc., a Wyoming corporation, duly and regularly caused the execution and delivery of a Warranty Deed, dated July 28, 1980, in favor of Donald E. Garrey and Patricia J. Garrey, husband and wife, as tenants by the entireties with right of survivorship, as Grantees, which Warranty Deed was filed for record in the Office of the County Clerk and Ex-Officio Register of Deeds within and for Lincoln County, Wyoming, on January 31, 2005, and recorded in Book 578, Page 74 under Receiving No. 906176. 5. That at the time of said purchase and conveyance, and the execution and delivery of said Warranty Deed, said Donald E. Garreyand Patricia J. Garrey, husband and wife, and said conveyance was made to them as husband and wife, and created an estate by the entireties in favor of said Donald E. Garreyand Patricia J. Garrey, and that they owned and held the title to all of said real property as tenants by the entireties continuously from said January 31, 2005 until the death of said Donald E. Garrey on April 21 ,2005. 6. That said Patricia J. Garrey is the surviving spouse of said Donald E. Garrey, and by virtue thereof, said estate by the entireties vested solely in Patricia J. Garrey upon the death of said Donald E. Garrey, and that she then became the sole owner in fee simple of all the real property hereinbefore particularly described. 7. That this affidavit is made in accordance with the provisions of W.S. Section 34-6-102 (1977), renumbered as W.S. Section 2-9-102 (1977, as amended), and that the Certificate of Death hereunto annexed, and by this reference made a part of this affidavit, is a copy of the official death certificate of the decedent, Donald E. Garrey, certified to by the public authority in which such original death certificate is made of record.
