Wyomlag LilDited Llabillty Company, ("Grantor") for a good and valuable considention, the receipt of which is hereby acknowledged, do hercb)' grant, convey and wurant wto Lower Valley Enersy, a Cooperative Corporation, of Afton and Jackson, Wyoming and to its S\M:CCSllOI'S and assigns, ("Grantcc8"), a perpetual cuc:ment and right of way for tht: construction and continued maintenance, repair, alteration and rcplacc:mcnt of the electric distribution circuits, linea and equipment of the Grantee to be constructed and maintained under, upon and across the: premises of Grantor in LIaeolD Coanty, State ofWyomlag, along stine describcd88 fonows, to wit: BEING s portion of Lot 13, Alpine Village Subdivisionl, Plat I, Amanc!ed, Section 18, T37N, Rl18W, ill Lincoln County, Wyoming more particularly described 88 foUows. BEGINNING at a point being the SB comer of said lot 13, nmnin¡ thence S S9"22'SI" W, 18S feet to 1 transfonner location. Bucm&m.t to include a strip of land 20 feet in width running parallel with south line c f said lot 13. EASEMENT to include 10 feet on each side of described line, together with aU ncceaary and reasonable rights of ingrcas and egrcas III1d to excavate and refill ditches ad trenches for the location III1d repair of said facilities ad to cut, trim, spray herbicides, or remove trees, shrubbery, undergrowth or other obstructiors interfering with the repair III1d mainteoance of the facilities. The Grantor aclmowledpø 1bat Electric and Magnetic Fields (EMF) are naturaUy oc:cl.UtÍng in tI'.e transmission or distribution of electricity, and that the Grantee baa here notified Grantor that EMF testir g III1d information ia available upon request from the Grantee. This Easemc:nt by Grantor is intended 10 include so much spac:c 88 is necessary or appropriate to the presence ofBMF and reasonable operation of the Grantee's distribution lines. Grantor agrees that all poles, wires and other facilities, installed on or under the described lands shd I remain the property of the Grantee removable in the sole discRtion of the Orantcc at the Grantee's expense. The rights, conditions and provisiOl1l of this easemmt shall inure to the benefit of and be binding upon the parties, their heirs, executors, administrators, successors and assigns. Grantor shall compensate Grantee f)r any damages to Grantee'. facilities caU8ed by Grantor, including payment of Grantee's attorney fees if action ia undcrIa1œn by Grantee to enforce the commitments described in this easement. Grantor reserves the right to improve, occupy and use this euement for III purposes not inCODllÍlltm1t with the easement grant. Each party shaD have the remedy of specific performance regarding this euement.
