TO
DECLARATION OF COVENANTS, CONDITIONS
AND RESTRICTIONS
THIS AMENDMENT TO DECLARATION OF COVENANTS, CONDITIONS
AND RESTRICTIONS is made as of December 2 J !': 2006, by Gaylon G. Heiner aka Gaylon
Heiner and Kristi G. Heiner aka Kristi Heiner, husband and wife, and Russell H. Juillerat, a
married man as his sole and separate property, and Zara H. Juillerat, a married woman as her sole
and separate property.
WHEREAS, Gaylon G. Heiner aka Gaylon Heiner and Kristi G. Heiner aka Kristi
Heiner, husband and wife, acted as Declarants and filed the Declaration of Covenants,
Conditions, and Restrictions that was recorded in the land records of Lincoln County, Wyoming,
on January 9, 2003 in Book 509 PR at Pages 170 through 175 as Instrwnent No. 886768
(hereafter, the "Declaration"); and
WHEREAS, said Declaration of Covenants, Conditions, and Restrictions control the use
and enjoyment of property in the area of Bedford, Wyoming, which property is more specifically
described as follows: the SWl/4 SWl/4 of Section 2, T33N, R118W, Lincoln County,
Wyoming (hereafter, the "Property"); and
WHEREAS, thereafter, Heiners and/or their successors in title have conveyed title to the
Property such that the following have now hold interests therein:
Russell H. Juillerat, a married man as his sole and separate property, owns that
portion of the property that was identified in the Warranty Deed that was recorded in the
land records of Lincoln County, Wyoming, on November 14, 2005 in Book 604 at Pages
612 and 613 as Receiving No. 913672;
Zara H, Juillerat, a married woman as her sole and separate property, owns that
portion of the property that was identified in the Warranty Deed that was recorded in the
land records of Lincoln County, Wyoming, on November 14, 2005 in Book 604 at Pages
616 and 617 as Receiving No. 913674;
Gaylon G. Heiner aka Gaylon Heiner and Kristi G. Heiner aka Kristi Heiner,
husband and wife hold a mortgage interest on the Property pursuant to the Mortgage that
was recorded in the land records of Lincoln County, Wyoming, on January 9, 2003 in
Book 509 PR at Pages 178 through 181 as Instrument No. 886770, and the Assignment &
Amendment of Mortgage that was recorded on November 14, 2005 in Book 604 at Pages
618 through 623 as Receiving No. 913675; and

WHEREAS, Gaylon G. Heiner aka Gaylon Heiner and Kristi G. Heiner aka Kristi
Heiner, husband and wife, acting as Declarants and as Mortgagees, and Russell H. Juillerat, a
married man as his sole and separate property, and Zara H, Juillerat, a married woman as her sole
and separate property, acting as the current fee owners of the Property, desire to amend the
Declaration to allow for the right to create an additional lot within the Property.
NOW, THEREFORE, for and in consideration of the covenants contained in the
Declaration and this Amendment to Declaration of Covenants, Conditions, and Restrictions, and
Ten Dollars ($10.00) and other good and valuable consideration, receipt of which is hereby
acknowledged by the parties, the Declaration on the Property is hereby amended in part as
follows:
SECTION 4. LOT DIVISION. in ARTICLE III
PROVISIONS is hereby amended to read as follows:
MISCELLANEOUS
SECTION 4. LOT DIVISION. The property may be subdivided twice into three
(3) separate parcels. If such division is made, then all of the provisions herein shall apply
to all three (3) parcels.
All of the remaining covenants within the Declaration are hereby ratified as if restated
herein in full.
IN WITNESS WHEREOF, the parties have executed this Amendment to Declaration of
Covenants, Conditions, and Restrictions as of the day and year first above written.
