AMMENDMENT TO COVENANTS, CONDITIONS AND RESTRICTIONS
FOOTHILL HEIGHTS SUBDIVISION
THIS AMMENDMENT is made as of Feb QZ1., 2007, by Call Property
Developments, Inc., hereinafter referred to as "declarant", the majority owner of the property
described as the Foothill Heights Subdivision, consisting of Lots 1, 2, 3, 4, and 5, located
within the N1/2NW1/4 of Section 7, T31 N, R118W, south of Afton, Lincoln County,
Wyoming, and which is hereinafter referred to as "the properties" or "the lots" or "the
Subdivision". A subdivision plat for the Subdivision has been prepared by Surveyor
Scherbel, LTD., approved by the Lincoln County Board of County Commissioners as of July
5th, 2006, and recorded in the office of the Lincoln County Clerk on the 8th day of Sept, 2006,
as Plat No. 84-D ("the plat"). The provisions contained on that plat including, without
limitation, the easements for Foothill Drive and utilities, are incorporated herein by this
reference.
NOW, THEREFORE, declarant, pursuant to the rights granted under Article IV
Section 4 of the unamended Covenants, Conditions and Restrictions as recorded Sept 8th,
2006 in the office of the Lincoln County Clerk, does amend and modify the Covenants,
Conditions and Restrictions in the following manner:
1. Article II, Section 4, Part a) shall be modified to read:
The minimum floor area of any single family residence shall be not less than
one thousand five hundred (1,500) square feet at ground level for a rambler/ranch style
home and not less than one thousand two hundred (1,200) square feet at ground level for a
two story home exclusive of a garage, carport, porches or decks and other outbuildings.
All other portions of the Covenants, Conditions and Restrictions shall remain
unmodified and shall continue with full force and effect as originally recorded.
IN WITNESS WHEREOF, declarant has executed this Amendment as of the day and year
first above written.
