HomeMy WebLinkAbout927531 000050 Land Lease Agreement Grover Cemetery District PO Box 583 Afton, WY 83110 Grover Cemetery District, c/o Joann Merritt, District Chainnan, grantor ofthe County of Lincoln, State of Wyoming, for and in consideration of an initial payment of SIX HUNDRED ($600.00) dollars and an annual payment of SIX HUNDRED ($600.00) dollars to be made on or before January 30, of each year starting with the year 2008 and other valuable consideration in hand paid, receipt of which is hereby acknowledged, CONVEY (S) AND WARRANT (S) to SILVER STAR TELEPHONE COMPANY, INC., grantee of Freedom, Wyoming, a land use agreement for the benefit ofthe Grantee on the following described real estate situated in the County of Lincoln and State of Wyoming, for the following purposes and under the following conditions: 1. Purpose of Lease. This lease agreement shall be for a 25 feet wide by 25 feet long parcel of real estate to construct, operate, repair, maintain, relocate and replace thereon buried or aerial telecommunications or electrical facilities, including a monopole to mount microwave dishes and antennas. The grantee may trim or remove trees or other objects that pose a threat of damage to the utilities. Once initial equipment has been installed, no additional equipment shall be added without pennission from the grantor. 2. Description of Lease. A 25 feet wide by25 feet long parcel described as follows: Starting at the NW comer of the NW Y4 of the SE Y4 of Section 6, T32N, Rl18W thence; S40021 '03"E a distance of302.42 feet to the True Point of Beginning, thence Easterly 25 feet, thence Southerly 25 feet, thence Westerly 25 feet, thence Northerly 25 feet to the True Point of Beginning, together with ingress, egress rights to the above described real estate along the now existing roads or reasonable access as conditions change. See Exhibit "A". 3. Abandonment of Agreement. This agreement is for a period of 5 years and at the end of 5 years the agreement will automatically be renewed for each subsequent 5 year period unless either party chooses not to renew the agreement and notifies the other party in writing not less than 90 days prior to the end ofthe 5 year period. Silver Star will be responsible for the removal of all equipment and site restoration if the agreement is tenninated. 4. Binding Effect. The tenns and conditions ofthis easement shall be binding upon the inure to the benefit of the heirs, successors and assigns of the parties named in this instrument.
