HomeMy WebLinkAbout927820 000164 ASSIGNMENT OF EXISTING EASEMENT RIGHTS For $10 and other good and valuable consideration, the receipt and sufficiency of which are hereby acknowledged, EOG Resources, Inc., with an address of 600 Seventeenth Street, Suite 1000 North, Denver, Colorado, 80202, does hereby transfer, convey and assign to Williams Field Services Company, LLC, with an address of One Williams Center, WRC3-9, Tulsa, Oklahoma 74172, the following described existing easement rights, limited to the route described ("Pipeline Route") on the lands described in Exhibit A hereto ("Subject Lands") situated in Lincoln County, Wyoming: 1. Those certain easement rights and pipeline obligations arising under the Oil and Gas Lease dated July 27, 1972 by and between Champlin Petroleum Company, as lessor, and Amoco Production Company, as lessee, recorded in Book 102 PR, Page 405, to install, operate, and maintain a pipeline in and along the Pipeline Route on the Subject Lands to connect the Fabian Ditch 533-09E well. 2. Those certain surface use rights and pipeline obligations arising under the Surface Owner's Agreement dated May 23, 1991 by and between Western Wyoming Range Limited Partnership, as grantor, and Union Pacific Resources Company, as grantee, recorded in Book 302 PR., Page 38, Document No. 739010, to install, operate, and maintain a pipeline in and along the Pipeline Route on the Subject Lands to connect the Fabian Ditch 533-09E well, as such use pertains to Township 19 North, Range 112 West, 6th P.M, Section 9: All, except the E/2NE/4 and 40 acres in the W/2NE/4 described in Warranty Deed Book 6, Page 122 and by metes and bounds as: Beginning at the North y.¡ comer of Section 9 and running east on section line one fourth of a mile to the NE comer of the NW/4NE/4 of Section 9, thence running south on the 1/41/4 section line one half mile to the SE comer of the SW/4NE/4 of Section 9, thence running in Northwesterly direction on a straight line to the north y.¡ comer of Section 9, the point of beginning, Lincoln County, Wyoming. 3. Those certain surface use rights and pipeline obligations arising under the Surface Owner's Agreement dated May 9, 1999 by and between J.R. Broadbent, also known as Joseph R. Broadbent, as grantor, and Union Pacific Resources Company, as grantee, recorded in Book 302 PR., Page 34, Document No. 739009, to install, operate, and maintain a pipeline in and along the Pipeline Route on the Subject Lands to connect the Fabian Ditch 533-09E well, as such use pertains to Township 19 North, Range 112 West, 6th P.M, Section 9: All, except the E/2NE/4 and 40 acres in the W/2NE/4 described in Warranty Deed Book 6, Page 122 and by metes and bounds as: Beginning at the North y.¡ comer of Section 9 and running east on section line one fourth of a mile to the NE comer of the NW/4NE/4 of Section 9, thence running south on the 1/41/4 section line one half mile to the SE comer of the SW/4NE/4 of Section 9, thence running in Northwesterly direction on a straight line to the north y.¡ comer of Section 9, the point of beginning, Lincoln County, Wyoming. In addition to the foregoing, this Assignment is expressly made subject to the provisions of that certain Gas Gathering, Processing, Dehydrating and Treating Agreement dated February 1,2004, as amended, and to all restrictions, exceptions, reservations, conditions, limitations, interests and other matters, if any, whether of record or not. Assignor shall properly execute, acknowledge, and file this instrument of record immediately upon receipt thereof, and will furnish to Assignee the recording data promptly after Assignor receives such recorded instrument from the clerk in each county in which this instrument is recorded. The terms, covenants and conditions hereof shall be binding upon, and shall inure to the benefit of, the Assignor and the Assignee and their respective successors and assigns.
