ENHA CED SEPTIC SYSTEM INFORMATION

WHA T ARE EN ANCED SYSTEMS? While standard tank and drainfield
systems are th most common type of onsite wastewater disposal system,
more advanced ystems are available that greatly increase the quality of
septic tank was ewater discharge. These systems are called enhanced
treatment syst ms, They include Intermittent Sand Filter systems, A TU's
(Aerobic Treat¡ent Units) and Textile Filter systems. Aerobic Treatment
Units consist of two types: Suspended Growth (usually single compartment)
and Fixed Film ( sually multi-compartment).
WHY ARE ENHANCED SYSTEMS REQUIRED? Standard tank and-
drainfield systems provide good environmental protection when placed in
good soil conditions with adequate spacing between systems. However,
where soils are too porous or the water table is too high or spacing between
systems is tight, more advanced treatment may be required. At the time of
writing, approximately 250 subdivision lots have been approved in the Star
Valley area, since 2002, with the provisionthat enhanced treatment be
employed. 20 + systems are installed and working.
WHICH SYSTEMS HAVE BEEN APPROVED SO FAR? Neighboring states
have been using levels of BOD (Biological Oxygen Demand) and SS
(Suspended Solids) as performance indicators for enhanced systems.
Wyoming DEQ (Department of Environmental Quality) has recommended
maximum levels of TKN (Total Kjedahl Nitrogen < 25 mg/ml) and Fecal
Coliform bacteria reduction« 800 colonies/l00ml). The enhanced systems
approved in our area, consist of either Textile Filter or Fixed Film Aerobic
Treatment Units:

These enhanced systems have shown that they can reduce Nitrogen toooo
c' f',' :"'.t·~~çê.ptable levels without alteration. They have also shown significant 493
.", J. '~eduction of Fecal Coliform levels as well. Number of colonies is typically
r'educed from tens of thousands down to between 1,000 - 3,000
colonies/l00ml. In order to further reduce these levels, there needs to be
either good soil structure below the drainfield or a disinfection device ahead
of the drainfield. Engineered requirements for enhanced systems may
include a provision for ultra violet treatment where ground water separation,
is less than six feet.
WHA T IS THE REASON FO~ A MAINTENANCE AGREEMENT? Whenever
mechanical components are added to a system, additional maintenance is
required, As stated above, standard septic systems do protect the
groundwater WHEN PROPERLY DESIGNED, WHEN PROPERLY INSTALLED
AND IF PROPERLY MAINTAINED. Without proper maintenance, standard
systems can and do fail. Enhanced systems require semi-annual inspections
including annual sampling. The attached form is a contract between the
property owner and Lincoln County that will be completed and filed with the
County Clerk. The county commits to ongoing record keeping and
enforcement with this agreement. The property òwner commits to proper
ongoing operation and maintenance of the enhanced septic system.
HOW MUCH WILL MAINTENANCE COSTS BE? Treatment systems that
bear the NSF International Standard 40 seal of approval include the
inspection and sampling costs for the first two years in the purchase price.
Beginning with the third year, the property owner is responsible for the cost
of ongoing semia~nualinspections including the annual sampling. Evidence of
test results and proof of service contract renewal shall be made available to
the Office of Planning and Development each year. It is projected to cost
between $150.00 and $200.00 per year for the service contract beginning
with the third year. As with standard septic systems, periodic pumping will
be required. However, due to the regular inspections, a recommendation to '
, pump the tank will happen when actually required, instead of too late or too
often.
GOOD NEWS, BAD NEWS! The bad news is that enhanced septic systems
require ongoing maintenance. The good news, for groundwater, is that
enhanced septic systems require ongoing maintenance! " )

and Lincoln County, 'Wyoming (hereinafter referred
RECIT.A.LS:
A. Owner is the O\7i/ner of real property located in Lincoln County, Vlyoming,
more particularly described below (the "Property"):

B. The Property is such that an Enhanced Wastewater Treatment System (the
"Treatment System") must be installed in order to meet the requirements of
the Lincoln County, '\Vyoming Zoning Resolution and/or the Lincoln County,
'\Vyoming Subdivision Resolution. Or the Owner has voluntarily chosen to
have an enhanced wastewater treatment system installed.
C. lnorder to comply with W:yoming Department of Enviromnental Quality
Regulations: the Owner shall provide for the ongoing inspection, sampling
and maintenance of the Treatment System.
D. As the Small '\Vaste'\vater Facility delegated authority, the County also
requires the Owner to agree to provide for the ongoing inspection, sampling
and maintenance of the Treatment System.
NO\V, THEREFORE, Owner agrees as follows:
1. Upon installation of the Treatment System and the execution of this
Agreement, Owner shall provide annual evidence of ongoing Treatment System
maintenance in the form of sampling results AND a copy of service contract for the
following year with a provider authorized by the Treatment System's manuÍacrurer.
2. O'wner is requireò to keep the Treatment System on the Properiy iµ good
operation, condition anò repair, Some repair or replacement costs may not be covered by
a servIce cODtraci. Owner will be responsible to pay all costs not covered.

3. Owner's obligation to this Agreement shall continue unless a connection to a
central sewer is obtained and/or the requirement is eliminated by the County.
4. This Agreement J3.nd the obligations on the part of the Owner hereunder shall
be perpetual and shall run with title to the Property and shall be binding upon Owner and
Owner's heirs, successors: assigns: transferees and grantees. This Agreement will be
recorded in the Office. of the County Clerk to provide notice of the obligations of the
Owner and Owner's heirs: successors, assigns, transferees and grantees to maintain the
Treatment System. Owner agrees to notify the County of the name of any new Ov,rner
upon the transfer ofthe Property. .
5. Failure to provide tbe County with evidence of annuaJ effluent sampling AND
evidence of an ongoing maintenance contract shall constitute a violation of the County
Small Wastewater-Regulations (February, 1986).
6. Violation of the provisions of the County Small \Vastewater ReguJations
(February, 1986) shall be deemed a misdemeanor. Each and every day or portion thereof
during which any violation of any of the provisions of the regulation is committed,
continued or permitted shalJ be considered a separate offense. Upon conviction of any.
such vioJation, such a person may be punished as provided by law witb a fine of up to
$750.00 and 10 days in jail per day ofvioJation.
7. Owner hereby grants to the County, the service contract pròvider and their
agents, for the tenn of this Agreement, an easement on, over and across the Property to
access, inspect: maintain, monitor and service the Treatment System, including annual
sampling of effluent and periodic sampling of the settled solids.
IN WITNESS \VHEREOF, the O\VNER has signed this Agreement to be
effective the day and year first above written.
