Sr., who are also the beneficiaries of the Estate of Tony Garal McIntosh, Sr., being duly sworn
and under oath, hereby stating as follows:
1. That Tony Garal McIntosh, Sr, died in Lincoln County, Wyoming, on February
20, 2007. An original copy of the Certificate of Death issued for Tony Garal McIntosh, Sr. is
attached hereto.
2. That at the time of his death, Tony Garal McIntosh, Sr. was a resident of Bedford,
Lincoln County, Wyoming.
3. That at the time of his death, Tony Garal McIntosh, Sr. was a single man, with
five surviving children: Blake Hoopes McIntosh, Dale Riley McIntosh, Keith Lamar McIntosh,
Robert William McIntosh, and Tony Garal McIntosh, Jr.
4. That Tony Garal McIntosh, Sr. had a Last Will and Testament that provides that

5. That pursuant to Wyoming Statutes § 2-4-101(c)(ii), we are also the heirs at law
of Tony Garal McIntosh, Sr. There are no other persons having any right to the property of Tony
Garal McIntosh, Sr. under probate proceedings in the State of Wyoming.
6. That the value of the estate of Tony Garal McIntosh, Sr" wherever located, does
not exceed One Hundred fifty Thousand Dollars ($150,000,00),
7. That more than thirty (30) days have elapsed since the death of Tony Garal
McIntosh, Sr,
8. That no application for appointment of a personal representative for the Estate of
Tony Garal McIntosh, Sr. is pending or has been granted in any jurisdiction.
9. That at the time of his death, Tony Garal McIntosh, Sr. owned the following
property:
a. 1963 HMDE Horse Trailer (No VIN, Registered only as Make HMDE,
Year 1963, Body Horse);
b. 2002 Polaris Snowmobile (VIN 4XANJ6ES42B252669);
c. 1999 Polaris Snowmobile (VIN 4XACH33A9XDI32602);
d. 2000 Polaris All Terrain Vehicle (VIN 4XACH50A3YA061996);
e. 1962 Ford Jeep (VIN 201 003);
f. 2002 Siems Snowmobile Trailer (VIN IS915101721481504); and
g. 2004 Chevrolet Truck (VIN2GCEKI9T541273593).

That we hereby request that any monies due and owing to Tony Garal McIntosh,
Sr. or the Estate of Tony Garal McIntosh, Sr. be paid to the "Estate of Tony Garal McIntosh, Sr."
and that those monies be sent to the Estate in care of Robert William McIntosh, Personal
Representative, 6644 Richland Place, San Antonio, Texas 78244,
11. That we hereby request that the debts owed by Tony Garal McIntosh, Sr. at the
time of his death, and the debts incurred by the Estate of Tony Garal McIntosh, Sr., be paid in
full.
12, That after payment in full of the debts of Tony Garal McIntosh, Sr. and the Estate
of Tony Garal McIntosh, Sr., we hereby request that such sums remaining in the Estate of Tony
Garal McIntosh, Sr. after payment of said debts be paid into the Tony Garal McIntosh Trust
dated December 31, 1997.
13, That we hereby request that title to the 1963 HMDE Horse Trailer (No VIN,
Registered only as Make HMDE, Year 1963, Body Horse) that was owned by Tony Garal
McIntosh, Sr. be transferred to Robert William McIntosh as Personal Representative of the
Estate of Tony Garal McIntosh, Sr.; that he have the same appraised; and that he then sell the
same and deliver the proceeds therefrom to the Tony Garal McIntosh Trust dated December 31,
1997.
14. That we hereby request that the 2002 Polaris Snowmobile (VIN
4XANJ6ES42B252669) that was owned by Tony Garal McIntosh, Sr. be transferred to Robert
William McIntosh as Personal Representative of the Estate of Tony Garal McIntosh, Sr,; that he

have the same appraised; and that he then sell the same and deliver the proceeds therefrom to the
Tony Garal McIntosh Trust dated December 31, 1997.
15. That we hereby request that the 1999 Polaris Snowmobile (VIN
4XACH33A9XD132602) that was owned by Tony Garal McIntosh, Sr. be transferred to Robert
William McIntosh as Personal Representative of the Estate of Tony Garal McIntosh, Sr.; that he
have the same appraised; and that he then sell the same and deliver the proceeds therefrom to the
Tony Garal McIntosh Trust dated December 31, 1997.
16. That we hereby request that the 2000 Polaris All Terrain Vehicle (VIN
4XACH50A3YA061996) that was owned by Tony Garal McIntosh, Sr. be transferred to Robert
William McIntosh as Personal Representative of the Estate of Tony Garal McIntosh, 8r.; that he
have the same appraised; and that he then sell the same and deliver the proceeds therefrom to the
Tony Garal McIntosh Trust dated December 31, 1997,
17. That we hereby request that the 1962 Ford Jeep (VIN 201 003) that was owned by
Tony Garal McIntosh, Sr. be transferred to Robert William McIntosh as Personal Representative
of the Estate of Tony Garal McIntosh, Sr.; that he have the same appraised; and that he then sell
the same and deliver the proceeds therefrom to the Tony Garal McIntosh Trust dated December
31, 1997.
18. That we hereby request that the 2002 Siems Snowmobile Trailer (VIN
18915101721481504) that was owned by Tony Garal McIntosh, Sr. be transferred to Robert
William McIntosh as Personal Representative of the Estate of Tony Garal McIntosh, Sr.; that he

have the same appraised; and that he then sell the same and deliver the proceeds therefrom to the

That we hereby request that the 2004
Chevrolet Truck
(VIN2GCEKI9T541273593) that was owned by Tony Garal McIntosh, Sr. be transferred to
Robert William McIntosh as Personal Representative of the Estate of Tony Garal McIntosh, Sr.;
that he have the same appraised; and that he then sell the same and deliver the proceeds
therefrom to the Tony Garal McIntosh Trust dated December 31, 1997.
20. That the method of appraisal of the above named properties will be an equitable
method determined by the Personal Representative of the Estate.
21. That each of the above named properties may be purchased for 90% of the
appraised value by any of the above named beneficiaries, Should more than one desire the
purchase of a particular property, the purchaser will be decided randomly by an equitable method
determined by the Personal Representative of the Estate.
22. That this Affidavit of Survivorship for the Estate of Tony Garal McIntosh, Sr. is
made pursuant to Wyoming Statutes §§ 2-1-201 et seq.
