Brannan, Trustee of the James H. Brannan Trust Revocable Trust Agreement, dated April 2, 1982 and James H. Brannan, Trustee of the Arlene G. Brannan Trust Revolcable Trust Agreement, daterd April 2, 1982 ("Grantor"), hereby grants to PacifiCorp, an Oregon Corporation, d/b/a Rocky Mountain Power its successors and assigns, ("Grantee"), an easement for a right of way 10 feet in width and II feet in length, more or less, for the construction, reconstruction, operation, maintenance, repair, replacement, enlargement, and removal of electric power transmission, distribution and communication lines and all necessary or desirable accessories and appurtenances thereto, including without limitation: supporting towers, poles, props, guys and anchors, including guys and anchors outside of the right of way; wires, fibers, cables and other conductors and conduits therefor; and pads, transformers, switches, vaults and cabinets, along the general course now located by Grantee on, over, or under the surface of the real property of Grantor in Lincoln County, State of.lIll, more particularly described as follows and as more particularly described and/or shown on Exhibit(s) "A" attached hereto and by this reference made a part hereof: Legal Description: A parcel of land being part of Tracts 73 and 74 of the survey of T.21N., R.1l6W., of the 6th P.M., Lincoln County, Wyoming and being more particularly described as follows: Beginning at corner number 1 of Tract 74 of the resurvey ofT21N., R1l6W., of the 6th P.M., Lincoln County, Wyoming where is found a standard U.S.G.L.O. brass cap: thence S89°42'19"W along the northerly boundary line of said Tract74. 263.99 feet to the common corner of lots 13 and 20 of Section 1 of said resurvey of T21N., R1l6W., where is found a 3" brass cap appropriately stamped by Paul N. Thence S13°11'54"E along the easterly right of way boundary of said Highway 233, 209.55 feet to a point where said highway right of way jogs east, Said point being monumented with a rebar with a 2" aluminum cap stamped "CCI, PELS 5465, WY ST 233, ROW, 100 RT". Thence N76°43'19"E along the easterly right of way boundary of said Highway 233, 50.00 feet to a point where said right of way jogs. Thence continuing along the said easterly boundary of said Highway 233, 116.32 feet along the arc of said curve to the rigth to a point of the curve. Said curve to the right having a central angle of 3°14'07", a radius of 2059.86 feet and a cord of 116.30' which bears S11°39'59E. Said point being monumented by a rebar with a 2" aluminum cap stamped "CCI, PELS 5465, FN-11/FN-12, ROW." Thence N89°53'04"E, 1283.53 feet to a point on a curve to the left on the westerly right of way boundary of U.S. Highway 189; Thence along said westerly boundary of said U.S. Highway 189 519.02 feet along the arc of said curve to the left to the point of curve to spiral where is found a standard Wyoming Department of Transportation concrete right of way monument (herein referred to as a standard R.O.W. monument) stamped "CS-32+156.571, 33.500 LT" with other appropriate markings. Said curve to the left having a central angle of 16°00'01". a radius of 1858.57 feet and a cord of 517.34 feet which bears Nl°41 '04"E; Thence continuing along the westerly right of way boundary of U.S. Highway 189 along a spiral curve left from said curve to spiral to the spiral to tangent of said curve. Said spiral portion of said curve having an arc of 319.07 feet and a central angle of 4°46'29". The cord ofsaid spiral portion of said curve bearing N9°33'14"W and being 318.90 feet long (318.83 calc. record). The point of spiral to tangent being monumented by a standard R.O.W. monument stamped "ST 32+256.571,33.500 LT" with other appropriate marking; Thence continuing N11°06'33"W along said westerly right of way boundary of U.S. Highway 189, 356.45 feet (356.32 feet record) to a point on the westerly boundary of said Tract 73 where is foound a standard R.O.W. monument stamped "ROW POLrrL- 32+365.178,33.500 LT" with other appropriate markings; Thence So025'27"W along thewesterly boundary line of said Tract 73, 89.73 feet (89.59 feet record) to the point of beginning. Said parcel contains 35.273 acres more or less. Assessor Map No. Assessor Parcel No. Together with the right of access to the right of way from adjacent lands of Grantor for all activities in connection with the purposes for which this easement has been granted; and together with the present and (without payment. fherefor) the future right to keep the right of way and adjacent lands clear of all brush, trees, tim~er, structures, buildings and other hazards which might endanger Grantee's facilities or impede Grantee's activities. At no time shall Grantor place, use or permit any equipment or material of any kind that exceeds twelve (12) feet in height, light any fires, place or store any flammable materials (other than agricultural crops), on or within the boundaries of the right of way. Subject to the foregoing limitations, the surface of the right of way may be used for agricultural crops and other purposes not inconsistent, as determined by Grantee, with the purposes for which this easement has been granted. The rights and obligations of the parties hereto shall be binding upon and shall benefit their respective heirs, successors and assigns.
