REVISED ACCESS ROAD EASEMENT DEED
THIS ROAD EASEMENT DEED is made and entered into on this 5th day of
June, 2007 by and between Thomas D. Crank and Corina E. Crank, husband and wife,
having an address of 1422 7th West Ave, Kemmerer, WY 83101 ("Grantors") and The
Pittsburg & Midway Coal Mining Co., a Missouri corporation, having an address of
116 Inverness Drive East, Suite 207, Englewood, CO, 80112 ("Grantee").
RECITALS
1. Grantors and Grantee entered into a Special Warranty Deed dated March 30,
2006 recorded May 3, 2006 in Book 618, at page 700, in the records of
Lincoln County, Wyoming that reserved unto Grantee a perpetual access
easement over and across the property purchased by the Grantors.
2. Grantors desire to relocate this easement in order to accommodate their need
as the affected landowners.
3. Grantors and Grantee now desire to identify the revised location of the
easement for public record.
4. This Revised Access Road Easement Deed replaces and supersedes the
easement addressed in the Special Warranty Deed dated March 30, 2006.
AGREEMENT
Grantors, for good and valuable consideration, the receipt of which is hereby
acknowledged and in further consideration of these covenants and agreement of Grantee
herein contained by these presents, insofar as they have the right to do so, grant a
perpetual access road easement for ingress and egress for the purpose of operating and
maintaining the Quealy 1 and Quealy 2 Ditches over and across the property described in
the Special Warranty Deed. The easement shall be 60.00 feet wide, being 30.00 feet each
side of the center line described in Exhibit A attached hereto.
IN WITNESS WHEREOF, this Agreement has been duly executed this 5th day of June,
2007.

Said easement being 1640.64 feet in length more or less.
Thence N 34°45' 31" E, 1082.75 feet to the point of terminus. Said point being a
point on the northerly boundary line of said P&M Parcel FN-4.
Thence N 84° 18' 40" E, 464.34 feet;
Thence N 30° 16' 39" E, 93.55 feet;
Thence N 54° 49' 43" W, 82.33 feet along said north right of way boundary
of highway 233 to the Point of Beginning of this description.
Thence N 89° 41' 56"E along said north township line 229.72 feet
to a point on the north right or way boundary of Wyoming State Highway
233 where is found a 2" aluminum cap on 5/8" diameter rebar stamped
"CCI, PELS 5465, HWY ROW, JOG RT, 2005."
Thence N 89° 14' 09" E along said north township line 221.62 feet to the
W 1/16 comer of said Section 2 where is found a standard U.S.G.L.O. brass cap.
Thence S 89° 44' 06" E along said north township line
838.65 feet to an angle point on said township line being
monumented by a stone.
Thence N 89° 27' 42" E along the north township line of said
T21N, R116W a distance of 260.70 feet to comer number 4
of Tract 76 of said T 21 N, R 116 W where is found a standard U.S.G.L.O.
brass cap;
Commencing at the northwest comer of Section 2 of the resurvey of T 21N, R116 W,
where is found a standard U.S.G.L.O. brass cap;
An access road easement for ingress and egress across a portion of Lot 8 of Section 35 of
the resurvey of T 22 N, R 116 W of the 6th P.M., Lincoln County, Wyoming. Said
easement being 60.00 feet wide and being 30.00 feet each side of the following described
center line. The outside boundary lines of said easement extending or truncating at the
boundary lines of Wyoming State Highway 233 and a parcel of land known as P&M
Parcel FN-4.
