RIGHT OF WAY EASEMENT
For value received, Kenneth G. Spears & Joan A. SpearslLarry J. Siddall & DeniseE, Siddall,
("Grantor"), hereby grants to PacifiCorp, an Oregon corporation, its successors and assigns, ("Grantee"),
a non~exclusive easement for a right of way 10 feet in width and approximately589 feet in length, more
or less, for the construction, reconstruction, operation, maintenance, repair, replacement, and removal of
electric power transmission, distribution and all necessary or desirable accessories and appurtenances
thereto, including without limitation: supporting towers, poles, props, guys and anchor, wires, fibers,
cables and other conductors and conduits therefore; and pads, transformers, switches, vaults and cabinets,
which to be located within the easement along the general course now located by Grantee on, over or
under the surface ofthe real property of Grantor in Lincoln County, State of Wyoming, more particularly
described as follows and as more particularly described and/or shown on Exhibit(s) "A" attached hereto
and by this reference made a part hereof:

An electrical power line easement through that particular parcel of land as identified as parcel
FN-3 as shown on survey map 261-A on record with the Lincoln County Clerk as receiving
No. 916795 (herein after identified as Frontier North Parcel FN-3) and being part of Tract 76
and part of Lots 6 and 7 of Section 2 of the resurvey ofT 21N, R116W and being part of Lot
No. 37 and Lots 8,27 and 28 of Section 35 of the resurvey ofT22N, R116Wall of the 6tll P.M.,
Lincoln County, Wyoming, Said easement being 10.00 feet in width and being 5.00 feet each
side of the following described centerline:
Commencing at the northwest corner of Section2 of the resurvey of TI2N, R116W, where is
found a standard U.S.G.L.O. brass cap.;
thence 89°27'42" E along the north township line of said T 21 N, R 16 W, a distance of
260.70 feet to corner number 4 of said Tract 76 where is found a standard U.S. G.L, O. brass
cap;
thence S 89°44'06" E along said north township line ofT21 N, R116W, 838. 65feet to an angle
point on said township line being monumented by a stone.
thence N 89°14 '09" E along said township line 221.62 feet to W 1116 corner of said Section 2
where is found a standard U.S. G.L. O. brass cap,
thence N 89°41 '56" E along said township line 198.15 feet to a point on the northerly
boundary line of Wyoming State Highway 233 where is found a 2" aluminum cap on 518"
rebar stamped "CCl,PELS 5465, HWY ROW, JOG RT, 2005. "
thence S 54°49'46" E along the north right of way of said highway 233, 536. 46feet to the
point of beginning of that particular parcel of land herein referred to as frontier North Parcel
FN-3 conveyed from The Pittsburg and Midway Coal Mining Co, to Kenneth G. Spears and
Joan A. Spears, husband and wife, as joint tenants and Larry J. Siddall and Denise E. Siddall,
husband and wife as joint tenants by Special Warranty Deed as recorded in book 620 on page
617 on file in the Lincoln County Clerk's Office. Said point of beginning being monumented
by a 2" aluminum cap on 518" diameter rebar stamped "CCI,PELS 5465, FN-4IFN-3, ROW,
2005. "

Together with the right of access to the right of way from adjacent lands of Grantor for all
activities in connection with the purposes for which this easement has been granted; and together with
the present and (without payment therefor) the future right to keep the right of way and adjacent lands
clear of all brush, trees, timber, structures, buildings and other hazards which might endanger Grantee's
facilities or impede Grantee's activities.
At no time shall Grantor place, use or permit any equipment, material or vegetation of any kind
that exceeds twelve (12) feet in height, light any fires, place or store any flammable materials (other than
agricultural crops), on or within the boundaries of the right of way. Subject to the foregoing limitations,
the surface of the right of way may be used for agricultural crops and other purposes not inconsistent, as
determined by Grantee, with the purposes for which this easement has been granted.
The rights and obligations of the parties hereto shall be binding upon and shall benefit their respective
heirs, successors and assigns.
