MORTGAGE
ZACHAR~ w. MOORE AND SHAWNEE MOORE, hereinafter referred to as
mortgagor, of , does hereby
mortgage to KOZ CONSTRUCTION, INC., of
, hereinafter referred to as mortgagee, for the
sum of ONE HUNDRED EIGHTY THOUSAND DOLLARS, ($180,000.00), the
following described tract of land in LINCOLN COUNTY--STATE OF UTAH:
ALL OF LOT 27 OF TAYLOR SBCOND SUBDIVISION,
LINCOLN COUNTY, STATE OF WYOMING AS DESCRIBED
ON THE OFFICIAL PLAT THEREOF.
This mortgage is given to secure the following indebtedness: THAT
CERTAIN CONSTRUCTION CONTRACT AND PROMISSORY NOTE ENTERED INTO BY AND
BETWEEN THE MORTGAGOR AND THE MORTGAGBB STATED HEREIN.
The mortgagor agrees to pay all taxes and assessments on said pemises,
and a reasonable sum attorney's fees in case any of this indebtedness
is collected by an attorney, also to insurance all buildings now on, or
to be constructed on the premises, during the term of this mortgage.
Insurance company must be acceptable to the mortgagee, in a sum no less
than the face amount of this mortgage. Insurance shall be made payable
to the mortgagee herein and shall be held by the same until this
mortgage is discharged.
Any default in the terms, conditions and stipulations of the aforesaid
contract shall be deemed a default under the terms, conditions and
stipulations of this mortgage. upon any default the mortgagee shall be
entitled to proceed with the judicial foreclosure of this mortgage or
with other means of collection as permitted by law.
In witness whereof, the mortgagor, does hereby certify that this
mortgage and transfer represented thereby was duly authorized under the
terms, conditions and stipulations of the operating agreement of the
limited liability company named as mortgagor.
