WYOMING This agreement is made and entered into this /9 day of June, 2001 by and between Gloria Meltvedt owner oflot 47 and Eric and Melissa Butler owners oflot 48. Both of which are located in the Leon Livingston Subdivision being situate in Section 19, Township 37 North, Range 118 West of the Sixth Principal Meridian. Whereas the parties own real properties adjacent to one another in Lincoln County, Wyoming. Whereas the parties desire to create and establish certain easements, covenants, conditions, restrictions, rights and obligations in furtherance of a plan for the septic system easement. Therefore this agreement shall be binding upon the parties and their respective heirs, successors, and assigns, and all parties having or acquiring any right, title or interest in or to any part of the subject properties. WithPut limiting the foregoing, the parties hereto agree as follows: ' SEPTIC SYSTEM EASEMENT: The septic system for lot 47 shall be located on lot 48 of the Leon Livingston Subdivision. The owners oflot 48 grant to the owners of lot 47 an easement for the septic system and pipeline. The purpose of the easement shall include the right to reconstruct, replace, inspect, maintain, operate, improve and locate a septic system together with necessary pipeline, connections and structures in on and under the easement area. The owners of lot 47 are responsible for all bills that are incurred in such actions. Each of the parties will use reasonable care to restore the subject properties to the approximate condition and elevation that existed prior to construction and maintenance. The septic system easement shall be appurtenant to and for the benefit of both properties and shall be binding upon and shall inure to the benefit of the parties hereto and their respective heirs, successors and assigns. SEPTIC SYSTEM USE: The septic system shall not be used for any other properties than the subject properties. RECORDA TION: This agreement shall be recorded in the office ofthe Lincoln County Clerk in Kemmerer, Wyoming GOVERNING LAW: This agreement shall be governed by and construedRin accordance with the laws of the S41te of Wyoming. ..... rr '~ .
