DISTRIBUTION EASEMENT
KNOW ALL MEN BY TIŒSE PRESENT:
That the undersigned, Steven Shaen Carter, Trustee of the Steven Shaen Carter Revocable Trust dattod
March 22, 1995, ("Grantor") for a good and valuable considemtion, the receipt of which is herehy
a,cknowledged, do hereby grant, convey and warrant unto Lower Valley Energy, a Cooperative Corpomtioll,
ele Afton and Jackson, Wyoming and to its successors and assigns, ("Grantees"), a perpetual easement alld
right of way for the constJUction and continued maintenance, repair, alteration and replacement of the
electric distribution circuits, lines and equipment of the Grantee to be conslJUcted and maintained undfr,
upon and across the premises of Grantor in LIncoln County, State OfWYODliog, along a line described lIS
follows, to wit:
BEING a portion of property, as refCJTcd to in the deed recorded in Book 263 PR. on Page 25 I, with the
Office of the Clerk of Lincoln County, within HES 168, of Section 16, T34N, Rl18W 6th P.M., Linco:n
County, Wyoming more particularly described as follows.
BEGINNING at the B.L.M. type monument marking the Lloyd B. Baker PEILS 698, 2004 location ûlr
Corner No.3 of said RES 168, thence S 0°35'36" W, 707 feet; thence S 89"22'21"E. 275 feet to an cxistir.g
power pole and true point of beginning, known as point "A". Thence S 76°E, 179 feet; thence N 79°E, S I
feet to a transfonner location. Returning to point" A". Thence S 89° 22 '21"E, 2S feet to a point.
EASEMENT to include 10 feet on each side of described line, together with all necessary and reasonab:e
rights of ingress and egress and to excavate and refill ditches and trenches for the location and repair of said
facilities and to cut, trim, spray herbicides, or remove trees, shrubbery, undergrowth or other obstructior,s
interfering with the repair and maintenance of the facilities.
The Grantor acknowledges that Electric and Magnetic Fields (EMF) are naturally occurring in tl:e
transmission or distribution of electricity, and that the Grantee has here notified Grantor that EMF testing
and infonnation is available upon request fium the Grantee. This Easement by Grantor is intended to
include so much space as is necessary or appropriate to the presence of EMF and reasonable opemtion c.f
the Grantee's distribution lines.
Grantor agrees tbat all poles, wires and other facilities, installed on or under the described lands shall
remain the property of the Grantee removable in the sole discretion of the Grantee at the Grantee's expense:.
The rights, conditions and provisions of this easement shan inure to the benefit of and be binding upon the
parties, their heirs. executors, administrators, successors and II$signs. Grantor shan compensate Grantee fc,r
any damages to Grantee's facilities caused by Grantor, including payment of Gmntee's attorney fees : e
action is undertaken by Grantee to enforce the commitments described in this easement. Grantor reserves
the right to improve. occupy and use this casement for all purposcs not inconsistent with the easement grant.
Each party shall have the remedy of specific performance regarding this easement. The rights an;!
obligations described in this easement shall run with the land. This easement is not exclusive, and Grantc.r
retains all rights not specifically granted by this easement. This is the entire agreement of the partiu
regarding tIús easement, except as may be set forth in writing after the date of this easement and signed by
the partics. Grantor hereby mlC81lCS and waives all rights by virtue ofthc Homcatcad &emption Laws c.f
